I believed politics was much more than a bunch of self-important, privileged men dividing up the spoils of life-in-the-public-arena. I thought the system embraced everyone who had a stake in the outcome of every law considered and every vote taken. We had not yet been blessed by the work of the finest Supreme Court money could buy, where every decision had been paid for and lobbied by billionaires and millionaires, who understandably believe they're entitled to more representation than the single vote everyone else gets.”

To sleep with the ugly as well as the beautiful…Ha!“Forgive the coarse example, father, but that's what politics does to you…either you're kissing a thousand asses and spreading your legs a thousand times a day for short dollars, or sleeping with an occasional millionaire now and again.

What would you do, right? So, you start ‘Shtupping for Millionaires' and you get your life back, and you stop feeling like a 24 hour fundraising prostitute.”But I was speaking about…power. Do you know the secret of power, father? I'll tell you. To become powerful, one simply hangs on to power longer than the next guy. To hang on longer than the next guys means forging strategic alliances with those who hold the power, even if it goes against the vested interests of your constituents, from whom you won't hear anything for another two years, anyway. But like I said, power is most effective when it's furthering its own ends.

That was a simple lesson taught to all of us when we entered public office.“But that seems so self-serving, my son. Surely there are those in public life who set their course with greater integrity and resolve?”“Yes, father. They're called one-term politicians.”“This is all so very curious, my son.”"It's Strange, father. I'm constantly trying to understand how things could get so bad. When I first entered office, it was understood you weren't to get caught breaking the law or stealing from the cookie jar. Everything was fair game, but you weren't allowed to get caught. That was the cardinal rule. Steal from the poor, the blind, the crippled, but don't get caught.

“Nowadays, it seems that our government is in charge of payoffs for criminal deeds of catastrophic dimensions. The greedy son-of-bitches who brought down the financial system and triggered a worldwide recession are saved, kept in their jobs, and even allowed to collect bonuses, while the taxpayers pick up the tab.“Just think, father, Halliburton and its subsidiaries are allowed to fraudulently overbill the US Army for shoddy work in IRAQ (How many soldiers were electrocuted in their poorly constructed showers?) and we just pay the bills.“And, today, every one of those Grand Old Pigs whose political party ran us into an endless war in Iraq for no good reason, voted in tax cuts for yacht-owners, billionaires and oil company executives, and fathered a prescription drug benefit where the USA isn't allowed to use its buying power to lower prices (and, thus, decrease the deficit).

If they're so worried about deficits how could they have voted for renewing Bush's Tax cuts for millionaires, father. How could they, I ask you that?”“It is all a mystery to me, my son.”“Yeah, me too, father. Me too. Like how could I have become a cynical and jaded politician so quickly? Without even noticing.! Oh, there was much truth in the promises I made, father. I intended to do as much as was humanly possible for my constituents; meant to deliver as many jobs, as many laws and, especially, as many government contracts for my constituents as I could.”“So where are the lies you feel you must confess, my son?”

That, of course, meant taking stands on issues that offended the least number of eligible voters. We call that taking a ‘prudent' approach to electioneering, so that hopefully you end up looking good to supporters on both sides of an issue. A good example is my stated position on welfare reform, father.“Do you support it or oppose it, my son?”“The question is, father, how can I both support and oppose it at the same time. That's ‘prudent' electioneering.

The way it works, you develop simple answers to complex issues. Ask me my position on welfare reform, I'll tell you I plan to seek reform without seeking retribution.That answer, simple as it appears, will be interpreted by each side as providing a measure of my support, while ultimately requiring nothing from me except an occasional newspaper quote. The net result, of course, is a non-binding promise to do nothing.”“I am beginning to see the problem, my son.”“I have become a master of maintaining a ‘prudent' approach to most issues, father. When it comes to conservation and land-use issues, I am for “responsible development” and “controlled growth.” Ask me my view on capital punishment and I'll declare myself “morally opposed to the death penalty except under certain conditions.” Question my position on gun control and I'll tell you the problem isn't with criminals being too well armed, but with people like you and me being too poorly armed.”

Go ahead, ask me my stand on any issue!”“Aid to Afghanistan?”“I'll support it, but only after the Afghanni's put their house in order.”“Continuing price supports for U.S. farmers?”“I'll vote to eliminate price supports as soon as we figure out a better way to level the playing field in the international market.”“American corporations' usage of child laborers in third world nations?”“It's outrageous, immoral and barbarous; but what gives us the right to dictate morality to the rest of the world?”And tax cuts for the wealthy?”Ah, yes. That's the Million Dollar Queston, father, because the right answer will open the door to millions of dollars in campaign donations! Ask me my position on taxing the rich, so their obligations are commensurate with the privileges they enjoy as millionaires and billionaires., and I'll agree that, “Yes, everyone should pay their fair share”.

But I'll also note that “raising taxes now could jeopardize the entire economic recovery.“ Or I'll pretend this is part of a larger tax event that also hits small businesses and middle class taxpayers. I'll say whatever I have to say to keep the public's eye off the ball so they don't figure out for themselves that these millionaires are getting away with murder.”

“Surely, you must have taken a firm stand on some issues, my son?”“Absolutely, father. Those are the issues we politicians call “no brainers”, meaning you don't need a brain to vote for tougher laws against child molesters, or for American independence from foreign-produced energy, or for a couple of hundred other issues that have nothing to do with the goals of your fellow politicians or the lives of your constituents back home.

For many people, retirement conjures thoughts of soaking up the sun and finally being able to read the books we only had time to skim through before.

Yolande Mongeon has accumulated five years' worth of paperwork in her battle with WorkSafeNB. But for Yolande Mongeon, retirement means fighting WorkSafeNB for compensation benefits.

Mongeon was already on the Canada Pension Plan when she was injured at work. She was surprised when WorkSafeNB said her pension benefits had to be paid back because she was now also receiving workers' compensation.

"Contrary to the Act, they reduce workers' compensation benefits dollar for dollar based on the CPP you receive," says Mongeon.

Mongeon was "already in a frail state," and her problems with WorkSafeNB weren't helping. So she called Tom Barron.

Barron, a retired labour union worker and owner of injury claims firm Barron T. Labour Relations, is concerned about the problems workers face getting their benefits.He said the problems started when the Employee Workers Compensation Act was changed several years ago.

The agency tells injured workers to apply for Canada Pension Plan benefits, and when they go into early retirement, the same agency "reduces their benefits for what they get from CPP," says Barron.

"The consequences of the decisions made in the last 10 years are not in the best interests of the stakeholders," says Barron.
Policy 38.11 of the Workers' Compensation Act states that compensation and supplemental income, including CPP, cannot be over 85 per cent of the worker's pre-accident income.

The policy also says CPP is deducted from injury benefits only if the pension was given due to the injury. Many workers are instructed to pay back CPP funds even if it is unrelated to their injuries.While many workers are concerned by the situation, they aren't the only ones.

"Eighty-six per cent of decisions made by the (WorkSafeNB) board of directors are switched by the Appeals Tribunal," says Barron. "We are the complete reverse of every other jurisdiction in Canada, where the Appeals Tribunal only overturns decisions 25 per cent of the time."Barron says the board does this in the hopes workers won't appeal, so they can "limit their liability to the workers' compensation fund."
"For every two people denied benefits who appeal, there are eight more who don't appeal," says Barron.

The WorkSafeNB Annual Report says the number of appeals for 2010 increased 20.6 per cent from the previous year. But the tribunal is having trouble keeping up.
"They instinctively deny your claim, and the Appeals Tribunal tells them to fix it, but it could be two and a half years before that happens," says Barron.

Ronald Gaffney, chairman of the Appeals Tribunal, understands Barron's concerns.
"We say pension plans are not supplemental income, but the board says they are," says Gaffney.

"We just have a different interpretation of the legislation."
But the legislation can't be changed unless the issue goes to a higher level of the legal system.

"Employers don't ever appeal our rulings, and neither do claimants, considering they are universally successful when they come to us on this issue," says Gaffney.
The board isn't "bound to apply precedents from tribunal proceedings," despite the fact a quarter of all appeal proceedings involve this issue, according to Gaffney.
"Unless it goes to the Court of Appeal, it won't change."

Barron says by the time claimants get to the Appeals Tribunal, they are exhausted.
"They get these workers involved in a revolving door process," says Barron. "Then they send them to Workers' Advocates, who have piles of work to the ceiling due to the constant appeals.

"The advocates tell people there will be a four-month wait for their services, and then another six months before it goes to the Appeals Tribunal.
"And then, the tribunal will take a year to make a decision. And you have an injured worker who has been struggling to get benefits for years."

Guy Dagenais, manager of Workers' Advocates, says this happens all the time.
"The Appeals Tribunal says if your CPP benefits have nothing to do with your injury, then they can't be deducted," says Dagenais.Dagenais said he has had every case of this nature overturned by the Appeals Tribunal, and says the record speaks for itself.

"The board of directors doesn't agree with what we say."
WorkSafeNB employs up to 36 case workers per year. Their 2010 Annual Report says they "adjudicated 12,507 applications for claims last year."
"1,360 were rejected as being non work-related or an uninsured employer," the document states.
"Of those accepted, 5,971 involved lost time of at least one day ... and 5,171 were no lost-time claims."

Martine Coulombe, minister of Post-Secondary Education, Training and Labour, is standing behind WorkSafeNB."I respect the role of WorkSafeNB and its board members in their role to implement and enforce a number of Acts that set out workplace protections for both employees and employers," Coulombe said in an email statement.

"It is the responsibility of WorkSafeNB to make recommendations to government regarding amendments to legislation as identified by their Board of Directors. Government is ready to work with WorkSafeNB should they feel adjustments need to be made," says Coulombe.Crispina Caballero says WorkSafeNB does its best to take care of injured workers.

Caballero, director of fiscal economic planning for WorkSafeNB, says the time it takes to pay out a claim "depends on how complicated the claim is."
WorkSafeNB tries to be timely, especially when the need for money is urgent, says Caballero.

"I once got a phone call from a man on prescription medication, and he was on his last day of pills," says Caballero."He needed his meds the following day, so I got his name and it was taken care of."She says all benefits are "defined by legislation," but the numbers can be adjusted if the employee needs more compensation.

"If the amount they need is less than what they get from their benefits, we communicate with them," says Caballero."There's a chance for them to say something."
Caballero says claims are only denied under specific circumstances.

"If the accident is not work-related, then we deny the claim," says Caballero.
Diane Green, executive assistant to the chairperson, president and CEO of WorkSafeNB, says the board of directors is "just following policy."
Green says the board members know it's a flawed system."We realize the tribunal has a different approach," she says.

She cites a mandate risk from WorkSafeNB's Strategic Plan and Risk Assessment as an example of their attempts to work on the issue."It says we want to reduce Appeals Tribunal decisions that are inconsistent with WorkSafeNB policy," says Green.
"We realize the issue, and we're working our way around it."

However, injured worker Mongeon says the board should be doing more than work around this."There is a long-standing questionable practice by the Workers Compensation Board," says Mongeon."They see this happening, and do nothing to crack the fingers of people doing these clawbacks on benefits."Due to the circumstances surrounding her benefits over the past few years, Mongeon is now unsure about her future.

"My retirement is up in the air at the moment, I'm not sure I have the money.".

The Workers’ Compensation Statutory Bar Held Not Applicable in Newfoundland Maritime Matter The Supreme Court of Newfoundland and Labrador, Trial Division has ruled that the statutory bar prohibiting employees and their families from suing employers for injuries suffered or death occurred in the course of employment is inoperative in the context of navigation and shipping.

In Ryan Estate v. Universal Marine, the Court overruled the Newfoundland and Labrador Workplace Health, Safety and Compensation Commission (the “Commission”) and held that the families of two deceased fishermen were entitled to sue the designer, builder and inspector for the negligent design, construction and inspection of the fishing vessel “Ryan’s Commander” which capsized causing the deaths. This decision has significant implications for any business involved in shipping, the fishery and
offshore oil and gas, and could potentially have repercussions in other industries in the federal domain.

One of the fundamental principles of workers’ compensation regimes in Canada is the creation of a no-fault compensation system. In what has been described as the “historic trade-off”, workers surrendered their right to pursue civil remedies in return for the entitlement to workers’ compensation benefits in the event of a workplace injury or death. Employers pay into the insurance scheme, but in turn are protected from being sued. Essentially, an injured worker or the dependants of a deceased worker cannot maintain a claim in respect of a compensable disability or loss of support against the employer of the injured or deceased worker,any other employer covered by the Act, or any worker of such other employer. While there are certain specific exceptions, notably in the case of automobile accidents, the statutory bar is contained in every province’s workers’ compensation legislation.

Ryan Estate involved the interaction between the provincial workers’ compensation legislation, and matters of federal jurisdiction. The Constitution Act, 1867, divides certain powers into federal and provincial responsibilities. While workers’ compensation falls within in the provincial powers, considered to relate to
“property and civil rights”, there are circumstances where it may interact with
federally regulated industries, that is, those falling within the federal powers such as “navigation and shipping” as was the situation in Ryan Estate. When provincial legislation affects matters of federal jurisdiction (or vice versa), the courts may undertake an analysis of the nature or “pith and substance” of the impugned legislation to determine its applicability. The courts will also assess
the impact of the legislation, sometimes considering doctrines of
“interjurisdictional immunity” (“reading down” legislation which is otherwise constitutional) and “paramountcy” (the principle that federal legislation “trumps” provincial legislation).

Provincial workers’ compensation schemes have been found to be constitutional and to apply to federal undertakings. As well, other courts have found the statutory bar to apply in the context of federal undertakings. In particular, the British Columbia
Supreme Court upheld the statutory bar in Laboucane v. Brooks, a case also involving the fishing industry. Furthermore, the Ontario Superior Court of Justice came to the same conclusion in Dionne v. Ontario (Workplace Safety & Insurance Appeals Tribunal), a case considering the issue in the context of a nuclear power plant. Moreover, in an analogous situation, the Nova Scotia Court of Appeal concluded that provincial occupational health and safety regulations applied to the fishing industry in that province. This jurisprudence makes the result in Ryan Estate all the more surprising. The Court in Ryan Estate framed the constitutional argument as “simply that legislation relating to navigation and shipping was reserved to the Federal Parliament under The Constitution Act, 1867 and that Parliament had legislated in that field by reason of the Marine Liability Act and the Federal Courts Act and that neither of these pieces of legislation contained any bar against any action which an injured person was entitled to bring under Canadian maritime law, both statutory and common law.”

The Court held that the Workplace Health, Safety and Compensation Act (the “WHSCC Act”) impaired the right of injured parties to bring a civil action under the Marine Liability Act, a piece of federal legislation which addresses claims of persons or dependents of persons injured or killed in circumstances involving matters relating to navigation and shipping. The Court decided that liability in a marine context fell within federal jurisdiction, and found that the Marine Liability Act created a “federal right” to bring such an action. The Court further held that the statutory bar impaired the federal power to sue, which is “a core feature of federal legislation governing navigation and shipping” and “an essential element of the requirement for uniformity of legal rights in navigation and shipping situations.” The Court read down the WHSCC Act, holding that in the circumstances, the statutory bar was rendered inoperative.

The employers in Ryan Estate paid into the workers’ compensation regime, and some of the claimants received benefits, but the employers were not protected by the statutory bar. In other words, one half of the “historic bargain” was held not to apply. Further, the case suggests that this would now be true of all employment falling within “navigation and shipping” and, potentially, of any employment falling within the federal domain (aeronautics, fishing etc) where there is federal legislation that, like the Marine Liability Act, can be construed as giving rise to a federal “right” of action.

The Court distinguished Mersey Seafoods Ltd. on the basis that occupational health and safety is essentially one aspect of labour relations, which on fishing boats is generally a provincial undertaking. The conclusion in Ryan Estate has left the somewhat peculiar result that while the fishery is subject to provincial occupational health and safety regulation, it is not subject to at least the statutory bar provisions of the provincial workers’ compensation regime, although the two pieces of legislation are closely interconnected.

The Court did not discuss or consider the Laboucane or Dionne decisions mentioned above. In each of those cases, the respective Courts undertook a perhaps more pragmatic analysis of the interaction of the federal undertaking and provincial workers’ compensation statutory bar.

In Laboucane, the Court held that the statutory bar was solely within the exclusive jurisdiction of the province. The Court reasoned that the statutory bar was not “integrally connected with maritime matters” and that the fact that the accident happened on a vessel was “not enough to displace the characterization of the claim [of the claimant] as arising out of a workplace incident.” We would suggest the reasoning in Laboucane is equally applicable to, and should have been followed in, Ryan Estate.

In Dionne, the Court held that the statutory bar did not conflict with section 4 of the Nuclear Liability Act. The thrust of the Nuclear Liability Act is similar to the Marine Liability Act. That provision holds nuclear operators absolutely liable for breaches of duties created under that act, without proof of negligence. While the Nuclear Liability Act may outline a cause of action, it does not create a right to sue an employer that the statutory bar takes away. Based on that conclusion, which we would suggest should apply in the circumstances of Ryan Estate, the Court held that no consideration of paramountcy was necessary.

What this case means is that employers in shipping and navigation, and potentially in other federally regulated industries, are more likely to face civil actions resulting from accidents occurring in or connected to the workplace, and are less likely to be able to avail of the protection of the workers’ compensation statutory bar. We are advised that the Ryan Estate case is likely to be appealed.

Maybe there should be a teaching process , that tells the story about injured workers who are being mentally abused by the parties holding this meeting?

...At the hand of a dirty Workers Compensation System & there are many , many more Mr Clayton's right across Canada. ( Some democracy...some political system , isn't it?

It was six thirty on a Thursday night when I walked into the prisoners visiting area at the Remand Centre in downtown Edmonton and took my first look at Patrick Clayton who was dressed in the telltale blue prison issue coveralls and was sitting on the other side of the glass partition.

The man who I had spoken to on the phone on two previous occasions sported a brush cut haircut and was much older looking then I expected. The bags under his eyes hinted at the likelihood of many sleepless nights since he lost his freedom two weeks prior as a result of the much publicized hostage taking incident at the Workers Compensation Board (WCB) building at 9912 107 Street.

I instinctively picked up the visitor telephone and greeted him with "Hello Patrick, how are you?" to which he responded "Well, I've had better days".

I nodded my appreciation of what I felt he meant by that statement and then over the course of the next 45 minutes I set out to dig deeper into trying to understand who really was Patrick Clayton the man, the son, the father and the brother. More importantly, I was interested in learning the circumstances that caused him to bring a loaded 6.5 Weatherby hunting rifle into the WCB at 8:30 A.M. and take nine people hostage on that fateful Wednesday morning.

"Why did you do it Patrick?" I bluntly asked to which he blurted out his response almost instantaneously "I just got sick and tired of being treated like a piece of crap by WCB". When asked to elaborate on this he went on to tell me about a six year period of what he described as a "roller coaster ride" relationship with WCB of claim approval followed by claim denial and then benefit reinstatement followed by more claim denial, and on and on it went. "I never knew where I was going to stand with them from one day to the next, all that uncertainty was nerve racking and constantly wearing me down."

He told of the time a little over two years ago when WCB once again cut off his $496.03 a month benefits which he claimed seriously hampered his ability to continue with his biweekly visitation rights with his only son Brandon who was four years old at the time. "Brandon is my whole life and if I can't afford to be with him even if only for a short time and take him places and try to be a good father to him then my life ain't worth spit" he said and quickly turned away so I wouldn't see the tears that were starting to well up in his eyes.

After he had composed himself he went on to further tell me about how he then climbed to the top of the High Level Bridge and contemplated ending his life. "I sat there for about an hour but just couldn't build up the nerve to do it" he remarked, almost seeming to be apologizing to me for not having the guts to kill himself.

Eventually he was noticed by a passerby, whereupon the police and ambulance were called and after a three hour standoff he was coaxed down from the bridge and whisked off to the Royal Alexander for a psychological evaluation. After convincing the doctor that he had no intentions of hurting himself he was allowed to go home.

"I told the police and the doctor about my problems with WCB but it seemed like nobody cared, nobody gave a dam" he continued. Then, almost as an afterthought, he added "I received the bill for the ambulance which I still haven't been able to pay", Since that time he managed to keep it together for awhile with the help of friends and family, sleeping a few nights on somebody's couch here and there in wintertime, in the back of a car in summertime, borrowing money and collecting recyclables to make ends meet. This went on until the roller coaster ride with WCB reinstated his benefits once again.

Then in early October of 2009, he found himself again in all too familiar and similar circumstances. His benefits had once again been cut off by WCB who told him that his file was pending "further review" and he was told by Social Services that he didn't qualify for assistance because he still had an active file with WCB that hadn't been officially closed.

To all outward appearances it seemed that he had again fallen through the cracks of various governmental support systems and he saw his life once again spiraling out of control.

Out of survival instinct, he says he tried to do very physically demanding work as a concrete finisher with his brother's employer but the leg injury that had caused him to apply for WCB benefits in the first place made this next to impossible. He remembers limping home from work after long and grueling days and having to bathe his leg for long periods to bring down the swelling and lessen the pain and discomfort he was experiencing.

"I was miserable, I was in constant pain and I was again having problems being able to visit with Brandon on a regular basis. I felt that I was at the end of my rope. I didn't know what else to do or who I could turn to for help", he revealed.

So it was against this backdrop and with a mindset which he feels was born out of depression, frustration and desperation that 37 year old Patrick Charles Clayton gathered up the 6.5 Weatherby hunting rifle that previously belonged to his recently deceased grandfather and headed for the WCB building in downtown Edmonton on October 21, 2009.

"I don't even remember how I got there, I just remember feeling numb and that my life was over and this was going to be my last day alive. I thought that I had already lost everything including Brandon, and that I didn't have anything else to lose except my life. He stopped to reflect for a moment and then continued "I fully expected that before the end of the day I was going to lose that as well."

According to news reports, once inside the building he fired a single shot into a cinder block wall. No one was hurt by this round and there is no evidence that he intended to hit anyone. He then reportedly ordered people into the elevator and took them to the eighth floor. Once there, he locked himself and nine hostages inside a conference room. "I never had any intentions of hurting any of those people, I just wanted for someone to listen to my story and for someone to help me", he stated.

He further went on to describe how he had one of the male hostages compile a list of names and cell phone numbers so that their families could be told that they were doing well and not in any danger. According to news reports he then called 911 and provided the police with this information. He also reportedly immediately released a male hostage when it was discovered that the man had a preexisting medical condition.

"I reassured everyone that I had no intentions to hurt anyone, and we sat around the table and I told them my story as best as I could. Some of the women were crying which made me feel really bad but I told them that I was soon going to let them go", he explained.
Over the course of the next nine hours the hostages were allowed to leave one by one under different circumstances, some in exchange for food and cigarettes from the police, others when they said they had to go to the bathroom.

"Two of the ladies said they had to go to the washroom and I said yes, go ahead. I knew that they weren't coming back because the tactical squad would surely take them away, but I didn't care, I just wanted to show everyone that I wasn't a danger to anyone".

When asked about the truth of news reports about him giving his personal belongings to one of the hostages so that in the event of his death at the hands of police they could be given to his son, he nodded in the affirmative. "I fully expected as some point that the police would bust in and start shooting and I would be carried out in a body bag. I wanted Brandon to have something to remember his father by", he claimed.

At 6:18 P.M., however, the ordeal ended peacefully when he surrendered to police after being in constant contact with a police negotiator for most of the day. He was taken into custody and was eventually charged with nine counts of unlawful confinement, six counts of pointing a firearm, possession of an offensive weapon dangerous to the public, careless use or storage of a firearm and use of a firearm during the commission of an offence.

When I asked him if he had anything to say to anybody about what happened he asked me to tell other WCB claimants who found themselves in similar circumstances as him that "I rocked the boat for them" and he hoped that in some small way he was able to bring attention to their plight and make things better for them.

I then asked him if he had anything to say to the hostages and his reply was "I feel sorry for what they went through and I hope that in time they will forgive me and try to understand what drove me to do something so drastic".

I finally asked him if he was able to see Brandon since his arrest and that is when he couldn't control himself any longer and the floodgates of his held back, pent up tears opened wide and he began to cry a river of tears uncontrollably with his hands covering his face.

Feeling uncomfortable, awkward and somehow responsible for asking what was maybe a dumb question, I started to speak into the telephone that I was sorry only to realize that the line was dead, the time limit had expired, the visit was over and I then watched as Patrick Clayton walked away, swallowed up by the prison system that now was in complete control of his life that he had tried so hard to avoid.

This is how injured workers here in Nova Scotia who dare speak out against the unionized Nova Scotia Workers Compensation Board are treated. I was accused of owning a website that I did not. I was also paid a visit by the Halifax City Police, they informed me that the President of the NSGEU said she had a message left on the NSGEU answering machine by me and that my message was threating to her. I requested them to get that recorded message and we would soon learn , that I never called the NSGEU, because I would never be so stupid. I also requested that they charge her with public mischief, they never. I wonder why..could it have something to to with the brotherhood of unions?

I guess there was no such message, because I was never charged. I feel, that this police officer was just doing a favour for the NSGEU President, hoping to intimidate me once more. When I put anything up on the internet about the NSGEU or the WCB. I always make sure they know it is me, I have no reason to hide.

I am tired of being abused by this government agency (WCB), which by the way, falls under the Department of Labour's jurisdiction. In other words, the "government" which is suppose to be there to protect us ..is being used by political parties, to use and abuse us. So, this is why I refuse to vote for a political system made up of parties that abuses myself, and other citizens of Nova Scotia.

As you can read I am being accused of attacking individual people employed at the WCB . This is not so. I wrote Larkin and Arab back, as soon as I received this letter and told them to advance with their accuations,it ended, no further communications.

When the NDP formed "government" Priemier Darrell Dexter had two longtime friends on his transition team, they are Robert Chisholm Regional Director CUPE,and former NDP leader and Ray Larkin legal council for the Nova Scotia Government Employees Union. Dear Mr. Arrowsmith;

I have taken the liberty of providing your address to allow other interested parties to contact you in regard to this matter which may or may not result in numerous letters supporting my right to free speech, both orally and written.

It seems someone in WCB took exception to my 33 page letter to the WCB Board of Directors, the president of WCB, the Minister in charge of WCB and to the Case Manager Natasha Bakala who in essence was not the intended primary receiver of the letter but a secondary recipient who as I had indicated in the letter that she is not a qualified legal expert, nor is she a qualified medical expert and her explanations relative to claim 349 0479 were incorrect which seems to be the norm according to the documentary evidence contained in these file and admitted by WCB Medical Advisors and two Directors, one Dave Verbicky and the other a former Director of the old CSRC now known as the DRDRB, Dirk Smith.

The following statements were made by me within the context of the 33 page letter which I will if requested, post on the Internet. Unlike WCB I do believe in transparency and believe that there is nothing that I have written would be considered to be a direct threat or intimidation as you state in your letter. I would also advise you that in Canada that all citizens are guaranteed freedom of speech, orally and written. Freedom of speech allows a person to open discussion specific to any subject unless freedom of speech crosses the line and becomes a direct threat.

For example: I can discuss the threat of fire in a crowded hall but I do not have the right to scream “fire” I don’t know where you were born and raised and it may be that you were born and raised in a country that did not allow free speech, orally or written but all Canadians have the right to free speech. I also do not know where you received your legal training that you believe that you have the right to suppress any dialogue that does not pose a direct threat to the recipient of a letter. If discussing why disabled workers as well as most other citizens of this country view WCB systems with contempt and hatred I suggest that you use your investigative powers to determine why. Clearly, there are people within your organization that are causing the proven culture of denial and they must be found and fired.

Incidents of violent acts such as was witnessed by the hostage taking came as no surprise to me and a CBC reporter who interviewed me asked me if it may happen again. My answer was “Of course it will” and most likely will end in a worst case scenario then the incident with Mr. Clayton.

I have contacts all across Canada who are disabled workers and have requested my assistance with their claims which also includes a Case Manager who was employed by WSIB in Ontario who was totally disabled on the job just as was Thomas Shuchuk ( Alberta WCB) and had to fight for benefits that by law were entitled to. The people I have talked to had indicated that if they could get away with killing any doctor or WCB employee they would not hesitate. This is very disturbing to me as I do not believe in violence and if their claim had been adjudicated fairly and as Justice Friedman stated that at the end of the day a person should not feel that they have been treated unfairly.

In my expert opinion, Mr. Clayton should not be incarcerated as it is very clear that he most likely would or should have been diagnosed as having a mental condition called “Dissociation State” or “Dissociative Disorder“ at the time of his hostage taking. This disorder precedes PTSD which involves depression, anxiety, and substance use all which would have been caused by Mr. Clayton’s perceived or alleged treatment of him by WCB. In fact WCB is the primary contributor of workers who because of the culture of denial suffer PTSD. Studies have shown that losing a job or being unable to work is as stressful or more stressful then losing a loved one.

Accordingly Mr. Clayton should be institutionalized, treated accordingly until such time as an inquiry into his claims against WCB could be verified. What he done cannot be justified but why he did it should be public knowledge. Had Mr. Clayton been intent on hurting or killing any one he would have not gone to a public place, rather he would have stalked the individuals he believed were responsible and done whatever which may be the way another disgruntled worker may choose to do in the future. Clearly if a decision maker or doctor has not done anything wrong, then there is no threat of people resorting to violence because they feel that they have not been treated fairly.

In analyzing your silly and senseless letter directed to me it would be fair to suggest that WCB does not want to hear about the workers who have been illegally deprived of benefits and harbour extreme contempt and hatred for the people who have destroyed their lives as well as their families lives. What is wrong with discussing an extremely explosive situation with the President, the WCB Board of Directors and the Minister in charge of WCB. Would you rather that I or any one else when learning of a plot to cause injury or death to a WCB employee simply keep this information to themselves?

For your information I have discussed what could be done to fix the proven culture of denial with a Conservative MLA. His reply was to blow the whole thing up and start from scratch, replacing all WCB employees as well as the Appeals Commission. I also was contacted by a claimant who taped a conversation with another MLA who suggested that violence was the way to ensure change. Perhaps I could request that some of my contacts across Canada provide you with visual examples of a disabled worker who is depicted in a photograph hanging from his neck, this all caused by WCB.

I have also received e-mails from a disabled worker who did in fact steal guns to commit murder against WCB employees and he has no qualms about admitting that he did so. If you would like his name and where he lives, I am sure he would send you any information you require as to how your wonderful system has ruined his life. Would you rather not hear, see or discuss what you and your fellow workers are doing to disabled workers who have the misfortune to suffer injuries and diseases that arose out of and occurred during the course of employment and do not completely recover from these injuries or diseases. Eventually all your lies and illegal decisions will be brought out into the open.

You suggest that you are committed to providing a safe environment for WCB employees and customers. Who may I ask are your customers. From my understanding, your customers are disabled workers, the public and the employer a.k.a. stake holders. Please explain what you do to provide security for disabled workers or for employers who are victims of a corrupt system. Disabled workers in reality are victims by virtue of having their claims and benefits illegally denied and employers are victims by paying premiums into a system to provide for disabled workers and then having to pay additional support through taxes to pay for medical support and income support to the thousands of workers and their families who have become a burden on families, friends and society. This is not the system that was promoted by Meredith.

I suggest that you read my letter again and point out where I made any statements that made any reference to any direct threats or violent acts that would be construed as me being the one to carry out any threats or violence against anyone in WCB. I also have never suggested to any one that they should resort to violence in attaining justice. As you know or should know you do not shoot the messenger just because they are alerting you to the fact that the employees of WCB and the Appeals Commission face great dangers in their day to day lives simply because of the way they treat disabled workers and is brought on by themselves by illegal decisions. It is a well known fact that if you treat people with dignity, respect and fairness, a person should not fear for their safety. I take notice that you make no mention of Ms. Bakala’s disrespect for me when she sarcastically remarked that I am wasting my time and should find something better to do then to continue to fight for justice. If I am treated with respect, dignity and fairness, I treat others with respect, dignity and fairness and is the reason why I have no enemies other than WCB who I have heard despise me, am not afraid to go anywhere, can sleep at night and not have any fear for my safety.

For your information, knowledgeable people like myself pose a greater danger to WCB than some disgruntled and depraved worker who resorts to violence. Violence is not the answer. Education and knowledge is the answer. Rather than harm WCB employees a worker should be finding ways to harm WCB by attacking their bottom line which is all about money. If WCB can be found to be guilty of human rights violations or contravention of the Charter and forced by the courts to pay restitution to disabled workers, this is what disabled workers should be striving for, not resorting to violence.

There are thousands of employers who do not require any security simply because of how they treat employees and customers. The only employers and individuals who have to look over their shoulders are employers and individuals who lie and cheat their friends, relatives and customers.
Perhaps your letter should have been directed to Justice Friedman as he is directly responsible for planting the seeds of hatred into the minds of workers when he found that there was a culture of denial which there most surely is and cannot be denied especially when an independent and well respected Judge makes these findings after a thorough investigation. Much of this could have been rectified if long outstanding claims could have been heard as was promised by the lying and incompetent Conservative Government. The environment of mistrust, contempt and hatred of the whole system rests on the shoulders of each provincial government who support this environment.

Your reference to your position as Senior Security Advisor does not impress me, nor does it intimidate me. Perhaps if you and others such as the President, Board of Directors and the Minister in Charge of WCB would get off your fat asses, climb down from your ivory towers and remove your rose coloured glasses and get into the trenches with the real people like Justice Friedman and myself have done you would acknowledge that you have created an extreme environment of contempt, hatred and threats of violence by workers who before their involvement with WCB were peaceful, caring, loving individuals who would not think of hurting anyone.

For you to threaten me for speaking out is dictatorial and an abuse of power. I suggest that you read the letter over again and attempt to understand that this letter was directed more so to the Board of Directors. Mr. Kerr and Mr. Lukaszuk within the body of a request to Ms. Bakala to consult with her superiors prior to making any decision regarding chronic pain and how your chronic pain policy is discriminatory.

She also refuses to admit that Ms. Miller was provided permanent work restrictions by an Orthopaedic Surgeon restricting her to not using her hands at all which resulted in a total loss of earnings, yet no loss of earnings were ever provided. She was also found to have a PCI rating of 5% UE impairment bilaterally due to chronic pain caused by a residual CTS by an Orthopaedic Surgeon who at the request of the American Medical Association using the AMA Guides made this determination. Ms. Miller was illegally denied any benefits for chronic pain for a discernible medical condition as well as for chronic pain caused by a non discernible medical condition. Perhaps you should be investigating why rather than threatening me or is that beyond your capabilities.

I must say that I take exception to elected Federal Representatives making a national issue out of how Afghani terrorists are treated after they are captured, yet the Federal Government or the Provincial Governments don’t give a rats ass as to how Provincial WCB systems treat our own disabled citizens. I really could care less how a terrorist who blows up innocent women and children is treated, however I do care about how my fellow countryman are treated by WCB systems and I will continue to speak out regardless of intimidation or threats by you or any one else.
I ask you, who is better off, the Terrorist who knows and expects what the consequences of his actions are or the naïve and gullible worker who has been coerced by Provincial Governments that WCB will look after them, treating them with fairness, dignity and respect if they are suffer an injury or disease. That is a blatant lie as many disabled workers have found out. Disabled workers find out that their fate is death by attrition.

You end your letter suggesting that if I don’t curtail my behaviour of discussing (freedom of speech) how disabled workers feel that my access to WCB would be limited through a designated representative. Clearly, if a Case Manager is so thin skinned as to feel threatened by the mere mention of how disabled workers feel, I would suggest that the person is placed in some type of work environment where they can hide from the realities of life. Restricting access to WCB seems rather odd as I am not a claimant, I am instead a member of the public who have concerns of how disabled workers are treated.

My concerns and should be your concern as well as to why our taxes are being used to pay for health care costs and income support programs for disabled workers that I do not believe we should be paying for, as that was the whole idea behind the formation of WCB. Who may I ask would be the designated representative and how would this designated representative represent me when I have no claim. Personally I would prefer not to correspond with any of you as I do have better things to do than to correspond with a bunch of misfits that are responsible for countless suicides, family break-ups, alcohol and substance abuse, homicides as was determined by Justice Friedman who made many recommendations which were thrown into the garbage rather than to order an investigation into his allegations.

Personally I am not an injured or disabled worker, have never filed a claim and never will. My concern rests not only with justice for Ms. Miller, but justice for all workers who have had their claims and/or benefits illegally denied. There is nothing in this for me other than the satisfaction of having WCB and the Appeals Commission admit that they have made numerous mistakes. That is the only reward or satisfaction I hope to achieve.

Being that I have access to workers, newspapers, MLA’s and WCB’s throughout Canada, I will circulate your letter dated Feb.10, 2010 throughout Canada just to show how repressive the whole system really is. Clearly someone in WCB handed the 33 page letter to you and you either were ordered or took it upon yourself to threaten or intimidate me hoping to shut me up. Don’t be surprised if you receive mail form numerous disabled workers from across Canada. You may even be sent the picture of a disabled claimant hanging from his neck that you could circulate throughout WCB to show what Case Managers, DRDRB members and Appeals Commissioners are doing to disabled workers.

You certainly don’t commit suicide because you have a hangnail.

In closing, and to not offend anyone who are affected by what is happening in the real world, I will refrain from offending these thin skinned individuals who know that they are the reason why there is such contempt and hatred towards WCB employees by not discussing verbally or in written form any mention of how disabled workers feel. I will restrict my correspondence to the matter at hand but continue to provide disabled workers throughout Canada with assistance in their claims as well as lobbying MLA's to either fix the system or get rid of it entirely.

For your information, I am also representing another claimant who was denied any access to oral or written contact with WCB due to him stating to a Case Manager via a telephone call that WCB was bullshit and he would not be sorry if someone came in with a shotgun and blew every one away. This individual has been diagnosed by independent Psychiatrists and Psychologists as being homicidal and suicidal due to his mistreatment by WCB.

I have known this individual for nearly 60 years and prior to his severe injuries he was a loving husband and father, was not violent and he was respectful of all persons. For him to change this drastically is a cause for concern but you don’t have to be a rocket scientist to determine who caused this violent and disrespectful behaviour.

By the way, the surname “Lahey” has always been popularly pronounced “Lay – hee” for the majority of us, but, somewhere along the way, it has been perverted into the more lofty “Law – hee” … presumably, by the now defrocked “Bishop” to set himself on a higher plane. Most are familiar with that old saw about “the higher they are the greater they fall.” And this is one hell of a fall.

And so it should be.

Raymond Lahey is not singular in his prurient interests. The WCB Act is empowering the WCB staff and the Board of Directors to abuse the injured worker and deliver good service to the business community who just happen along with the unions run that private insurance company, you call WCB. All WCB’s in Canada are nothing more than private insurance companies , the only difference between then and say SunLife, is that Sunlife can be sued and comes under the consumer protection act…whereas the WCB’s are provided with legislation to abuse the victim and protect the client,that just happens to be BUSINESS, Government Department and UNIONS, who pay the fees. Since Injured Workers do not pay any fees, they are not considered as being stakeholders.

I also better understand why the media here in Nova Scotia go out of their way to avoid investigating the Workers Compensation Board … media are business and therefore will not do anything to bring down “their” protector, "they" finance the fund, the Board serve them, not those injured at "their" workplace. This is why I will not buy any local papers or buy into the local media.

Injured workers are oppressed by a bad faith law Nova Scotia Law, an illegal law that does not conform to the Canadian Constitution, we are not protected by the human Rights Act or it’s Commissioners, they are ignoring injured workers. WHY??

Lillian Carr suffers from loss of hearing which happened while employed with Hershey Canada. Moirs Factory Outlet in Halifax Nova Scotia where Lillian started out then moved to Dartmouth and was then purchased by Hershey Canada.

Between these two companies,Lillian was a long time loyal employee of 40 years . Her reward was to lose her hearing while working for this company and then to be ignored by the Nova Scotia department of Labour and "their" agency the Nova Scotia Workers Compensation Board. It should be noted that over the years the machinery in these plants was very loud and the company did not supply proper ear protection.

The Nova Scotia Department of Labour are breaching the Supreme Law of Canada, "The Constitution 1982 ". The Nova Scotia Department of Labour, and Deputy Minister Margaret MacDonald along with senior department bureaucrats are using section 167, 195 and 270 of the Nova Scotia WCB Legislation to circumvent the Constitution when it comes to section 15 of the Carter.

While I have been pushing for change in the way the WCB Law works here in Nova Scotia...the three injured workers groups here have been kissing the arse of the Department of Labour ...who by the way fund them to the tune of $82,500.00 each, every year. The Mainland Injured Workers , Cape Breton Injured Workers and the Pictou County Injured Workers association are not looking out for injured workers , if they were they would be protesting every day in front of the Department of Labour...but why would they want to bite the hand that feeds them together, well over $200, 000.00 to stay away?

So who else are these Department of Labour financed injured workers groups reporting to, the NSGEU? The Nova Scotia Federation Of Labour"? The Construction Association? The Federation of Independent Business or Just the Department Of Labour, who are using this law to protect their business and union buddies ?

April 28 was set aside to morn the death of workers killed on the job. It should be named the day of infamy because people like Jim Sinclair from the BC Federation of Labour and all the labour federations across the country,use this day to get up on the stage with the WCB and the Department of Labour,and the New Democratic Party, the very people that drive injured workers into going bankrupt.

This past while on CBC I have watched the Canadian Government paint British Member of Parliament as a terrorist and that this great humanitarian is someone we should fear. Well I am a born Canadian citizen of sixty years and not once has my life been threatened by M.P. George Galloway or Hamas, on the other hand I do worry about our own homegrown terrorists.

That’s right homegrown terrorists masquerading as a political party that claims to have served and protected Canadians. I speak about the Liberal Party of Canada, and justifiably so, because in 1966 and 1967 while I served with the Canadian Army at C.F.B Gagetown the Liberal party of Canada approved the use of Agent Orange on both British and Canadian soldiers while they were in training in the area.

Not only was this very deadly herbicide used on soldiers, but those civilian personal living and working in and around C.F.B Gagetown.

Then again in 1968 at Suffield Alberta the Liberal Party of Canada approved the testing of Mustard Gas on the soldiers, both incidents took place while Liberal Lester B Pearson and Liberal Pierre Trudeau were the Prime Ministers of Canada. To think that this political party used the power of “government” to abuse and endanger the very citizens who were employed to protect and serve Canada, are still bidding for political power to day makes me very afraid.

Further more, it truly sickens me as a Canadian that once again a political party is using the power of “government” to prevent a British Member of Parliament to enter Canada because they feel I need protecting from Mr. George Galloway. To be honest, if the Conservative Party that is now in the position to abuse the power Canadian voters have entrusted them with, they might want to consider placing the Liberal Party of Canada on their terrorist list, for it has been well documented that the Liberal Party of Canada has terrorized Canadians.

Further more, if the Harper Conservatives wish to charge the Liberal Party of Canada with crimes against humanity, this would be most welcomed by the victims of Agent Orange and Mustard Gas.

We all know the out come of this action, we know that farmers were paid off because this very toxic herbicide drifted onto their crops , the “government” purchased all crops on these fields so they could be destroyed, thus confirming that the consumption of this produce was not good for human consumption.

We have learned since that many health issues have come to pass from the spraying of Agent Orange and not to mention many questionable deaths.

Then again in 1968 under the watch of the liberal party of Canada, they authorized the use or testing of Mustard Gas at Canadian Forces Base (CFB) Suffield Alberta. What kind of people is in the Liberal party that would let these two incidences take place?
I have no other choice, but to point at the Liberal Party of Canada as being nothing more than totally responsible for these very disgusting acts. Were they ever held accountable? No! and why not? they?

Dear Minister Greg Thompson .

On February 19, 2004, the Minister of National Defence and Veterans Affairs recognized Canadian service personal from the Suffield, Alberta who were placed in harms way , when Chemical Warfare Agents were tested on them.

The National Defence Department and Veterans Affairs made a onetime payout of 24,000 tax free dollars to these personal . This amount of 24 thousand, is in addition to any disability pension benefits to which they would also be entitled.The situation is similar, to the Agent Orange used in 1966 and 1967, it too was a Chemical Warfare Agent ,used in the Vietnam War.

Except those involved at CFB Gagetown were never informed or asked if they were willing to take part in such test program.When the British Battalion “The Green Howards” along with many other foreign troops who came to train at CFB Gagetown, they too were never informed, why? How could the Canadian Government continue to let troops be trained in these contaminated areas at CFB Gagetown and why did it take so many years for this situation to be brought to the public‘s attention?

What is needed now, is a full blown public inquiry, because those citizens who live in and around CFB Gagetown deserve some answers also. Like why were the farmers compensated for crop damage and not those who had small family vegetable gardens, in the same area? Was it ok in the eyes of the government for those citizens to eat contaminated crops, while it was not safe for the farmers, and why the difference in concern?

One can only take the position, that if the government paid for the contaminated crops of those farmers who were unlucky enough to be in the drift area of the Agent Orange, then the Department of National Defence knew how deadly this chemical was. Therefore the Canadian taxpayer must be given an answer to why the government of Canada and the government of New Brunswick, permitted the use of this Warfare Chemical.

Then the question arises, should the province of New Brunswick be charged with breaching the Geneva Protocol, which Canada was a signature to in 1930? After all this vile warfare chemical , Agent Orange must have received the ok from the provincial government as well as the Federal government. We know that their was also a court case, whereby New Brunswick Power was sued for using Agent Orange and that the health of their employees was jeopardized.

Those employees did receive a settlement from NB Power, once again this is just another indication that Agent Orange has been recognised as a deadly chemical.All parliamentarians, in Ottawa are still avoiding those people who were placed in harms way and they have displayed their true colours this past week, when they spent their time and taxpayers dollars discussing a millionaire hockey players vocabulary problems. Who really cares, if Shane Doan told someone to f… off?

If this is any indication of how parliamentary committees function, then god help us.The question I put to all four political parties is this, do you have the will to address the Agent Orange situation and will you strike a committee looking into it ASAP? Agent Orange might seem like it is not an important issue for politicians, but trust me, it is , Canadians are watching.

The people who were employed at CFB Gagetown during the year 1966 and 1967 are being ignored by the department of National Defence and Canadian Veterans Affairs.

Peter Stoffer of the NDP has taken an aggressive stance against you and has called for your resignation at any opportunity he has had, with media here in the Halifax area, and, I presume, across Canada, as his party's Defence critic.

I was a member of the Royal Canadian Army in 1966, 67 and stationed at Gagetown during the time Agent Orange and other carcinogens were showered so liberally on unsuspecting Canadians.

I am not a supporter of ANY political party and, therefore, I will not stand for any politician using my life's circumstances to advance their political profile ... in fact, I find it reprehensible. Any politician who would stoop to this is the lowest of the low, in my opinion.

That said, it is precisely this cheap political gamesmanship that has made me recognize that political parties exist only for themselves. My faith and trust in what should be my government has long been nullified by such feigned expressions of umbrage, ostensibly on my behalf, in order to score points with the public.
Is this how Canadians are defined ... as a people prepared to sacrifice other Canadians by placing them in harm's way?

If it is, I am disgusted and ashamed to call myself "Canadian". Personally, I am apathetic about the amount of money you and the Department of Veteran's Affairs have offered to those afflicted as the final result of some politician's cavalier and careless regard for the lives of their fellow Canadians.

For your government to quantify the value of a life, with such an amount, is a slap in the face to everyone affected, to be sure ... but, for any politician, such as MP Peter Stoffer to attempt to make political points with the public, is just as big an affront.

It is disturbing and disgusting to think that MY government would allow and encourage the dispersement of those "rainbow" chemicals used so liberally in 1966 , 1967, and beyond ... while these same chemicals were outlawed for testing in the United States on that country's military.

I will never, ever forget or forgive this country for allowing some bureaucrat to believe that I, and all others who were exposed to these poisonous and life altering carcinogens, am no better than a lab rat.

My silence is not for sale .... nor will I be satisfied, until there is a full, expository inquiry into why this was ever allowed ...and further compounded by being part of a cover-up for the past forty one years. .

All political parties in Ottawa and the bureaucracy,are complicit in this cover-up.

Dear Honourable Senator Noel A. Kinsella:

I’m writing the Senate on behalf of those injured workers who don’t have a voice ~ or at least for those whose voices have fallen on the deaf ears of politicians who author laws based on political considerations ~ rather than morals, ethics or empathy.

I ask that the Senate, not try to excuse themselves or the Federal Government, by saying the federal government, has no jurisdiction over the Workers Compensation Laws in Canada. You might not have jurisdiction, but as a full partner, the federal government has the right to intervene as an employer.

The fact of the matter is, the Federal government is a full partner in this vile legislation. Every Federal government department, is a stakeholders, because they (Feds) receive the full protection under this provincial law. All injured employees, of the federal government and their departments are required by law to file accident reports, in the province they reside as employers.

I have noted that when the provincial governments hold their reviews of their legislation, those stakeholder involved all are present, except there is no representation from the federal government, why?

This is a government that, at all levels, has increasingly become populated by professionals who have joined the political parties, that have usurped, what once was government for and by the people.

Unfortunately for the rest of us, our governments have become out of touch and unresponsive to the real needs of the people. Injured workers are real people and citizens who by way of a bad faith law, are abused by a system that professes to be their protector.

Injured workers in Canada are one of the sole partners of the Act, not all injured workers are represented, on the board of directors of the WCB, more often you will find that trade union and government unions who along with the business community sit on these boards.

Unions have the same interest as do the business community and government departments,because they also are protected and benefit from the legislation, as they are employers also.

I find it insulting that unions who hold seats on these WCB Boards, also can be found unionizing the staff of the WCB, surely they are in a position of conflict of interest. Then one must take into consideration that not all workers and employers who come under the WCB legislation belong to any union.

The professionals I refer to are the lawyers and doctors who have joined the professional politicians, whose aim is to establish tenure for themselves and, in some instances, their progeny. The motivating force behind these dynasties has to be the money, power and perks that accrue as one becomes entrenched within the system.

And why not ? Lawyers come from a profession that has been granted the right to police its members ( Barrister’s Society ) and similar privileges are extended to inoculate medical doctors from censure by any means other than the College of Physicians and Surgeons.

All very tidy and protective. Even the most blatant examples of abuse by erring members of these professions have gone unpunished ~ or, with the proverbial "slap on the wrist".

Those of you in the senate or parliament, who would disagree that the public perception is wrong are, yet again, demonstrating just how "out of touch" you really are. In Canada today, the myth is proclaimed and perpetuated that there is good government .

Good for whom? Mostly for the professionals and their professional societies that have been granted the right to administer their own law, as it pertains to their profession. Who granted that right?

Answer: Government, through legislative action by its members. Who are those members? Many come from the membership rolls of the very same societies who benefit from their protective legislation . Proving again that, in some instances, "incest IS best". The highly deserving and august professionals I refer to are, ostensibly, the" cream of the crop"~ lawyers and doctors trained to the nth degree in the intricacies of your professions but without , one must suspect, of never having been exposed to the nuances of morals, ethics and, particularly, empathy as you made your way through university.

The public perception, I’m sure , is that all of you professionals should be more than capable of shouldering the responsibilities inherent in government ~but you have unfailingly demonstrated the opposite, time and again by the results. Injured workers have been committing suicide because of the abusive and bad faith law called the Workers Compensation Act.

Government is probably one of the best illustrations of that old saw, " The Ark was built by an amateur but, .... the TITANIC was built by professionals !"
Considering all the training professionals have undergone, I would like to know when, and under what circumstances, they were dumbed down enough to author and ratify the laws that allow the WCB to go about its business in the manner it does in all the provinces in Canada?

I can’t believe any of you would stoop so low as to cheat on those courses you took that culminated in your being granted degrees.

That said, I can only conclude that the bad faith legislation you were either a party to or tacitly endorse today, is not the result of a mistake or any error in judgement. I call upon the Canadian Senate and all Members of Parliament to uphold the Human Rights Act, you expect other countries to abide by.

To the Senate of Canada, I ask that you set in place a committee, to review the Workers Compensation Boards and laws in every province in Canada where the federal government is a partner and stakeholder. I would hope, the federal government, would not want to be apart of Human Rights abuse, while being the authors of the Charter of Rights and Freedoms.

No ~ this legislation was maliciously calculated to confuse and confound those injured workers ~with legitimate claims who have been forced to rely on the Workman’s Compensation Board.This is the same WCB whose sole purpose, as they daily demonstrate, is to denigrate, intimidate and deny those claimants their legal, rightful and moral entitlements.

My attitudes toward you are borne out ~ indeed, validated ~ by NINE justices of the Supreme Court of Canada who have cited Nova Scotia WCB legislation as flawed in virtually every area.They have gone so far as to call WCB legislation unconstitutional.

The Dorsey Report in Nova Scotia spelled out clearly what must be done to repair the bad faith legislation, embodied in Bill 122, that was thrown together without any thought for the situations faced by injured workers, here in Nova Scotia There have been reviews ,in every other province, with a similar outcome, as that of James Dorsey.

AND don’t use that tired, old excuse," I was not part of that government at that time." Those of you who sit in the people’s Parliament were charged to correct and deal with Bad Faith Legislation. I pray that you find the will, to address this vile law and reply to my letter. It would be most welcoming to hear that the Canadian Senate will set in place a committee to review all WCB Boards and legislation in Canada, because the Federal Government is a stakeholder.

I want the Senate to forgive me if I come off as if I am against educated professionals, I do how ever find it very difficult to excuse those who turn a blind eye on this abuse.

Lillian Carr, 40 year employee of Hershey Canada....

...loses hearing because of employment, then gets abused by Worksafe Nova Scotia / WCB .

Lillian suffers from a loss of hearing due to years of working around very noisy machinery while employed for 40 years with Hershey Canada ( Moirs Plant ). Even though she was supported by all the required medical evidence, the Nova Scotia Workers Compensation Board, Hershey Canada and her union the Bakery Confectionery Tobacco Workers International Union tossed her way... WHY ?

In 2004, I managed to get Hershey Canada ( Moirs Plant ) to buy Lillian a hearing aid. Then the Nova Scotia Workers Compensation Board has purchased her two since. The last one just this month ( February 2009 ).

Therefore I would suggest that since they now recognise Lillians hearing loss, they might wish to honour her with the compensation benefits own to her, since 1992.

Lillian was accepted onto CPP Disability without any problem and that is what she lived on since, without CPP, the WCB would have downloaded her onto Community Services.

I recently received an e-mail from a sister of a young man whose death on the job was used for political purposes by the Workman's Compensation Board of Nova Scotia in a desperate attempt ( on their part) to show themselves as a caring and compassionate organization who has only the best interests at heart for workers injured in this province.

When put in the context of the history of the WCB ( and I have their history laid out to me on an almost weekly basis, these days)...their maudlin, manipulative production comes off as a cynical slap to the faces of injured workers whose lives have literally been destroyed by their arbitrary and callous actions. Actions which are supported and encouraged by this province's Department (Ministry) of Labour and successive ministers who have turned a blind eye to how the WCB goes about denying legitimate claimants ... while their coffers grow. Rodney MacDonald, it is speculated, will soon be asking for your vote to keep his "government" in power preferably, with a majority.

What follows is one of a litany of reasons why he and his party should be booted out of governing this province for a long, long time... and his successors should be prepared to clean up the WCB well and truly for once. That should preclude any majority for the NDP as well. Surprisingly, we have found trade unions in Nova Scotia are complicit as well in what has been done to injured workers ... they simply could care less.

My heart goes out to you and your family, but I cannot sit back and watch injured workers be abused by this dirty system. I had a friend who went into a electrical tunnel at the Heavy Water Plant many years back, just after it opened ...he and a co-workers also died from toxic chemicals....whose fault was that? Was that company every fined? This has happened many times before and will happen many time more , yet, as usual the Department of Labour and the WCB , always likes to place the blame at the feet of those who are lost to an unsafe workplace.... why?

We are well aware of the fact that the WCB pays out million of dollars in the name of injured workers. This money comes from the rates charged to the small business operator who has two or more employees. Injured workers too are concerned about the high rates the WCB are charging our small business community, so we want to help, you know, make sure that your dollars are well spent. You see not all money paid out ever gets to the pocket of the injured worker, but someone gets it, so lets find out who.

So, it is time that every single injured worker gets a copy of the financial breakdown of their claim number or numbers. Lets make sure we do not have another Enron on our hands.

This audit will ensure that the money the WCB claims department have been dolling out was done so legitimately. This audit will include the names of every person who received money from the WCB based on your claim number or numbers. Keep in mind that people are being paid using your name and number to collect.

Contact: Leo MacKenna or Brad Fraser in the Accounting department of the Nova Scotia Workers Compensation Board. If they refuse, then make application through the Freedom of Information Act to the FOIP Administrator: Janet Curry.

Deputy Minister: Margaret F. MacDonald:

I am directing this letter to you and the senior bureaucrats who sit in control and oversee the daily operations of the Department of Labour. Simply put, Cabinet Minister’s come and they go, but the most senior public servant’s who run the department and understand the system, are in my opinion the people we should be going to for answers and holding accountable. After all each and every one of you, are employed by the taxpayers to serve and protect and oversee the operations of “government”, you are not employed by a particular political party, even though they may have appointed you.

Those Ministers who are elected and claim to be there to serve the public have proven to be nothing more than worthless, other than the fact they tend nets, you know goalies, whose sole purpose is to deflect controversy away from the real managers of our system and when the rubber hits the road, these Ministers run and hide behind legislative immunity or are transferred out of that portfolio to another one and the abuse within the system goes unchecked. Surely, this is not how “government” is intended to work.

Since 1999 myself and other injured workers across Canada have been looking into the Nova Scotia Workers Compensation Board and the other Provincial WCB programs, what we have learned is most disturbing. Our division of the Abused and Injured Workers Coalition will express our concern’s and seek answers to why there is still on going abuse and bad faith being played out at the hands of the Nova Scotia Workers Compensation Board, under the guidance and watchful eyes of the Nova Scotia Department Of Labour.

Even thought the elected Ministers make the claim that the Department of Labour cannot intervene or become involved in the daily operations of the Board, we injured workers are no longer buying into this bunk. It is the duty of the department of labour to insure the principle which the Workers Compensation Legislation was based on, are acted upon, on a daily bases, and that these principals continue and trust me, the legislation is no longer working. The legislation is used to abuse.

The Workers Compensation Board bares all marking of a bureaucracy out of control, lacks accountability and one that operates knowingly in Bad faith, under the umbrella and protection of the Department of Labour.

It is most disappointing that the Department of Labour is funding three injured workers groups. Keeping in mind that these groups control who can joint “their” private, but public funded clubs. These groups collect $82,500.00 each out of the pocket of the taxpayers of Nova Scotia and refuse to supply a complete accounting break down to the public on how our dollars are spent within these Associations, why are you letting this happen?

When our group tries to make contact with the Nova Scotia Workers Compensation Board, it is made known to me that the Board only recognizes the three “government” funded groups, can you please explain this? Was it decided by the Department of Labour, that they would set up and finance three groups to monopolize and control the voices of injured workers?

Can you please explain to me who represents injured workers like myself and other injured workers when those “round table discussions” are held? Isn't this another display of Bad faith? I have been active in Nova Scotia when it comes to concerns of injured workers, yet no one extended a hand to myself or other to lend our voices, why? Is it because they cannot stand being questioned or held accountable?

Further more, the Mainland Injured Workers Association has its President and Vice President a husband and wife team, these two have maintained control of this group and the people they permit in the Association. As a matter of fact, according to several defectors from this group, the membership does not reflect the money “government” gives them. It has been drawn to our attention that the money rolls right back into the hands of the business community, rent, computers, office supplies, picture to decorate this office, gas allowance, meal and other such items that are of no benefit to injured workers, in other words another façade of “governments” doing.

This is no way to spend public taxes, while senior citizens are in need and injured workers are forced into poverty, hopefully this funding will be brought to an end.Injured workers do not need funding, we need justice.

Injured workers do not benefit from these three groups, these groups are functioning in a controlled environment, and cannot justify to the public that they are receiving value for these dollars.These "government" financed groups had to sign an agreement in order to get this funding, this agreement states that the funding cannot be used to assist injured workers, so what the point?

The Department of Labour has in place a Workers Advisor Program, another tax financed advocacy arm of the Department, surely this program has legal council which are more a tune to labour laws , so why pay for these three Injured Workers Association when this job should be done by the WAP Program, is it all show? Is this another attempt to lead injured workers blindly down a path that will only cause further disrupting in their lives? Do you care or is this the plan?

I am in the process of reading a thesis by Carol MacCulloch , written in 2000, this thesis is called : “Institutionalizing Failure: The Evolution of the Worker’s Compensation System in Nova Scotia ,” It is a very interesting study and one that I would recommend injured workers read, it gives a look into the way this present system is evolving.

I see the Workers Compensation heading towards being privatized, which would be something I could live with, but if it is to be privatized, then the Meredith Principles and that “historic agreement?” and the Bill of 1915 / 1917 will be done with. If the aim of “government” / Department of Labour through this “round table committee, is to privatize the WCB, then it must be understood the legislation dies and this new private Workers Compensation System must fall within the Private Insurance Legislation, leaving themselves open to tort law. You cannot privatize the WCB and make it a profitable business, and still keep it under the umbrella of the WCB Legislation, it would be in breach of the governments own law.

Yes the Workers Compensation Program needs reform, but it best involve those it will impinge on, “injured worker” and “small business.” Unions cannot represent, non union persons, lawyers should not be at the table, they are not payers and those belonging to government financed groups, who are they speaking for, government?

It is a sad day, when injured workers are placed under a law, that further disadvantages them and that within this law it is very evident that sections 167 and 195 are there to protect those who are in a position to use the Act to intimidate and perform in such a way, injured workers have been pushed to the edge and have either committed or attempted to commit suicide.

The treatment that I received by those employed at the Board has been less than professional and one thing for sure, they have proven to me that they do not and will not abide by the Workers Compensation Legislation if they so choose. This is why I have decided to put my own claim on the back burner and set out to fine just how many more Wayne Coady’s are out there, because I was of the opinion, that if they were doing this to me, then it was a safe bet that it was happening to others.

Will I make a difference? I hope, because I cannot sit back and watch this abuse continue, thank god I have an understanding and supportive family. Most injured workers are forced into bankruptcy, onto welfare, they and their families split apart. All because some caseworkers or claims manager whose only goal is to justify their job, has decided that since the Act protects them, they can and will do as they wish. The WCB staff know that their livelihood depends on the denial and review process. So they use it to their advantage, it helps maintain “their” family income, even thought it is at the expense of the injured client.

When you truly take a look inside the operation of the present Compensation Program the list of service companies that feed off the pain and suffering of injured workers is quite extensive and costly. These cost come in two forms, the cost of the mental abuse injured workers are forced to live under and the cost the expense to the small business person,who is forced to pay.Example fishers, small roofing and painting companies and so on. Big companies such as Michelin Tire and "government" department who receive the protection under the act, do not pay, except when an accident happens.

In other words, the small business owner is carrying the cost to maintain this vile WCB system.

Once again, I reflect back to the start of my letter to you Deputy Minister and the office of the Department of Labour and why I directed these concerns to your desk, simply put, it is time to take the politics out of the Act and make it work, but make it work as it should.

Injured Workers want to be treated with respect, we are tired of being treated as a commodity which benefits so many other and such a high cost to those whose only sin was to be injured in a workplace accident.

My name is Wayne Coady , I am involved with a national injured workers coalition, we are involved in investigating the bad faith practices of members of the Association of Workers' Compensation Boards of Canada, such as your Board in BC and other members of your association’s family, like the Workers Compensation Board of Nova Scotia. ( All others included. )

I have been involved with injured workers since 1999 and became involved because of the way I was treated by the Newfoundland Workers Compensation Board. So after years of jumping through their hoops , I was faced with much stress and eventually had a mental melt down, so I said Wayne , if it is happening to you, then it is happening to other.

Sure enough I learned that injured workers right here in Nova Scotia were going through the same kind of abusive treatment at the hands of these unionized caseworkers , then we learned that the abuse of power was also being displayed by those service companies who were hired by the WCB to service injured clients.

For example therapists hired by the board were using intimidation and that intimidation was placing much stress on the injured patient and in more case we learned that these therapists were threatening or as they call it these days bullying injured workers, no matter how great the pain was, if they did not do as the therapist demanded, they would be written as non-compliant …thus terminated by the WCB Board. This was and is still a very common practice.

So my small band of merry injured workers struck out to find more injured workers who had documentation and were willing to tape record all conversation between caseworkers, doctors and any other hired thug employed by these vile bad faith boards. Bingo, we learned that the abuse in one Board was the same practiced in all others. So, now we are educating and helping injured who have a story to sit in front of a camera, tell the truth and mention the names of each and every single person / caseworker who has abused them along their way, including therapists ,doctors and other health care providers.

Injured workers are now just starting to come together and right across this country, we are taking the bag off our head and putting aside the shame we were made feel. Injured workers will tell how the Compensation Board destroyed their life, forced them into bankruptcy, split apart their families and yes even drove the now widows, husband to suicide or visa versa. How the children and family were degraded by having to go to welfare, because some caseworker decided to play GOD with their life.

Christ you guys truly are cruel and miserable bastards and anyone that likes to call them-self a humanists who sits on the Board of Directors of these vile Compensation Boards is nothing more than a school yard bully. I hope they do not consider them-self to be a believer of Human Rights. I have also decided to take note who they are and to make sure that I never do business with them or the company they are associated with, unions included.

I have been following this latest case about Cascade Aerospace which Worksafe B.C. is involved in and thanks to being able to post as an injured workers on Kathy Tomlinson CBC site, I have received emails and phone calls from right across Canada and we have been overwhelmed with letters from injured workers from British Columbia.

I do not know who this Mark Evans is, other than the fact ,Mark Evans is manager of Corporate Security at WorkSafeBC. He is a certified controls specialist, forensic investigator, and fraud examiner.

Mark has 27 years’ RCMP experience in covert operations, drugs, organized crime, and major crimes. So what are the connection between Dr. Hugues Hervé, who is a registered psychologist in British Columbia,specializing in forensic and medico-legal assessments with Mark Evans or are there any?

I have noticed WCB Boards tend to hire retired RCMP. It must be a damn hard job, as I understand it people tend to look at the WCB as a legalized Mafia and a bunch of union thugs. Starting to understand now why these WCB Boards get away with the abuse and bad faith, they administer on injured workers. We sure live in one sick society, don't we. The reason brought up Mark Evans name was we received a flood of emails from injured workers in BC and his name came up more often than not.

If there was ever an agency that required investigating Mark your employed with it now.I guess if you want to leave a good impression hire a retired cop, take a sigh and say, there now the people will trust us!

Here in Nova Scotia the WCB / Department of Labour hire former media types and retired cops as well. As the old saying goes..keep your friend close and your enemies even closer, but employing them?

Well , now I suppose Mark will call one of his contacts here in Nova Scotia track me down and shake me down. I remember back in 1999, when the Nova Scotia WCB hired a retired RCMP officer, who ran his own investigation company to follow me around and watch who was coming and going at my home. They did this for two months, imagine how important that made me feel.

So, I would say that Mark is very well schooled in intimidation tactics, now I am not suggesting he would use them of course or do anything wrong. Because he knows injured workers are more equipped these days Mark, we record our conversation, even when they are done in secret and those sitting around the table are not introduced. Click!

As you know and are well aware , that stress leads to mental health issues and as we are also learning, has place a high number of injured workers in the position of either committing suicide or having made a failed attempt leaving them with another cross to bare. This is a fact, that is documented in the BC Legislature.

There seems to be a common practice that flows out of the management practices of all of these vile Workers Compensation Boards and that is get rid of the injured workers at any cost . Injured Workers across Canada have had enough of this abuse , that is being administer at the hands of the unionized staff at these vile government agencies and I stress Unionized.

I am going to make a suggestion that you can pass onto every person employed at Worksafe B.C. Mr. Scott McCloy ,I suggest that you contact Dr. Hugues Hervé, he is a registered psychologist in British Columbia, then have him put the WCB Staff through a Psychological Assessment, including Mark Evans. Mark a real secretive man, if you know what I mean !!

Trust me Mr. McCloy, injured workers are not going to stand for any more of this abuse, injured workers are more than willing to tell their story about how they were mentally abuse and some injured workers are of the opinion the the Workers Compensation is capable of out right murder and you know, I beginning to believe they might be right!

The British Columbia Provincial Government and all other Provincial Governments including the Federal Government will have little choice but to put in place a full blown public inquiry, this abuse must stop, injured workers are being murdered, by a piece of legislation which has been proven, that in the hands of the wrong people or organizations such as the WCB, the WCB Act is akin to a man gone mad with a AK 47.

This letter was to inform the Association of Workers Compensation Boards in Canada, that we are pissed off and sick and tired of the abuse we are forced to take at the WCB hands, no more. I cannot continue to write, because just having to write this make me want to toss my guts. I do have my own site, and so does the Injured and abused Workers Coalition, but for now that site is closed to the public, but in due time it will be opened.

Meet injured workers Dwayne Rowe.

Mr. Rowe first became acquainted with the Nova Scotia Workers Compensation Board back in 1992 when he was injured while employed at Dalhousie University. At that time Mr. Rowe was placed on WCB benefits and within six months he was cut off and told to go on welfare.

Mr. Rowe still under the medical care of a physician and was on pain medication which would have been another factor in his returning to work. So for 15 years Mr. Rowe was without choice force to take welfare only because a caseworker decided he was terminated.

Then one day he was contacted by the WCB to apply for a chronic pain payout and he did. Now keep in mind the WCB cut him off because they felt he was all better, but now they were ready to accept the fact that it was time to pay him for his secondary injured known as chronic pain, which came about because of his primary injury, which is still very much a factor to day.

This is just one of the many examples of how abusive the “governments” Workers Compensation truly is. What right does a caseworker or a rehabilitation therapists employed for or by the Nova Scotia Workers Compensation Board have to destroy an injured worker and his or her family?

Dwayne Rowe was forced onto welfare for 15 years, cut off from benefits that would have helped him and his family to move forward with their lives. What part did the Workers Compensation Board play in the splitting apart of his family?

Were Injured Workers Sold A Bill Of No Good

Fact or Fiction ? Do we have the original agreement between labour and business ?

I want to see the agreement that was signed in 1915 here in the province of Nova Scotia , between ...the Business Community and the Union Representative which led to the legislation called the Nova Scotia Workers Compensation act of 1917. It is important we see the original signed documents that removed our right to sue the employer.

I have learned today, Jan 7th 09 ,that there was no agreement signed between Labour and Business, I was told by the Legislative Librarian, that a Liberal by the name of Ernest Howard Armstrong introduced the bill which robbed workers of their right to sue their employer, should they have a workplace accident.

Here a little histroy on Ernest: Ernest Howard Armstrong, journalist, lawyer, politician, premier of Nova Scotia (b at Kingston, NS 27 July 1864; d at Bridgewater, NS 15 Feb 1946). Educated at Acadia and Dalhousie (LLB, 1888), Armstrong edited the Weymouth Free Press from 1889 to 1892, and later moved to Yarmouth, where he held various administrative posts. He was MLA for Yarmouth County (1906-20) and held the public works and mines portfolio in the Liberal government of Premier G.H. MURRAY 1911-23. A hard-working but unimaginative politician, Armstrong sought retirement to the bench when, as senior Cabinet member, he succeeded to the premiership (1923-25).

In other words, we are being lied to and the workers did not surrender their right to sue, government stole that right and have every year since 1917 kept stealing a little more of our rights away. This explains why the legal community does not want to tackle this vile abusive law....you see Ernest Howard Armstrong was one of their own, yes he was a lawyer, a liberal and a liar.

If that document / agreement between those two parties cannot be shown, then one can only assume the Workers Compensation Board is a FRAUD.What we have is nothing more than a FACIST piece of legislation used to further disadvantage those already disadvantaged by a workplace accident. Keep in mind also that when this vile legislation was passed, the men who it would most harm, were off fighting in the First World War, thinking they were defending democracy.

Well it looks like the Liberal Government of the day, pulled the wool over their eye. SHAME.

Human Rights Is A Myth Here In Canada

This is myself, Curtis Squires, Bob , Peter and Dave Wilson. The oil rig is the Bow Drill One.

This is where I first learned about abuse of power and breach of trust and how the Newfoundland and Nova Scotia Workers Compensation System abuse injured workers.

No matter where one looks in Canada at our (current) provincial or federal government system, we (will) can find many instances where agencies of our Provincial “governments” should be targeted for their abuse of power and breach of trust. In Nova Scotia, the Department of Community Services and the Workers Compensation Board have distinguished themselves by their reprehensible treatment of those people they have been sworn to protect.

Over the years, reviews of these agencies have been held (recently, we have learned that these reviews have not been as frequent or detailed as they should be... apparently, on purpose) and there have been many documented cases proving(categorically) continuing abuse of power has, and still is taking place right across Canada. Why hasn’t this problem been addressed and rectified? Political parties are bodies who will always jump on a cause when they feel they can gain points with the public and, hopefully, come off looking like the good guys who should be allowed to form a majority government.

Why then, is it so apparent that the slate of political parties in N.S. are afraid of championing a public inquiry into any government agency that abuses its power in this province? It's obvious that the CONservatives won't initiate anything... they're the "government" of the day. The Liberals sure as hell aren't about to dig up their old dirt because they have too many of their own transgressions to atone for when they were in power. The NDP, on the other hand, has never been the government. They have never had the chance to steal from the public purse or deny citizens their rights.

The NDP, because it has never been government is continually in a mode of proving to the electorate of Nova Scotia why it should be given the chance to govern. They should be on the bandwagon to clean up these government departments that proven themselves unworthy of the power and trust they have been given. BUT the NDP in Nova Scotia has shown itself it is reluctant to get into the fray. Why can that be? Could it be that they have a very cozy relationship with the Nova Scotia Government Union and the Nova Scotia Federation of Labour, the very union that unionized both the of these vile agencies of "government"? (Sinister aren't they )

Sure, we can point our finger at government, but, more importantly, we are overlooking those who do the abusing. You know... the human element, the staff. It's easy to point out that the abuse is being done and over looked by government, but what about that public servant who is delivering the abuse? Why should they get off easy? The most important component of that abuse is hidden in plain sight. One must take into consideration that these public servants are organized members of large unions, who, on one hand, profess to be staunch believers in human rights and, by default, great supporters of the Canadian Charter of Rights and Freedoms. Especially, when they can call public attention to themselves in a positive light.

These unions are very much the biggest hypocrites. In fact, (and action) they are not as interested in human rights as they would have us all believe. Time and again in recent months, media and others here in Nova Scotia have shone the light of fact and reality on many problems and shortcomings of the WCB and Social Services... apparently, to no avail. The abuses by these two agencies continue apparently with the tacit approval of the unions and their political arm, the New Democratic Party. In fact, the NDP recently announced it was content to go with the status quo...and this in a time when a full blown no holds barred public inquiry should be the order of the day.

Taxpayers are being held hostage by political parties that have been hijacked by a bunch of self serving elite, whose only apparent interest, thus far, is filling their pockets with your tax dollars. Included in this mix we have large government employee unions, whose only agenda is to control and protect their brethren who are employed in these vile government public service bureaucracies. Dues are paramount. More important than rules of basic morality or humanity.

Why should anyone trust a political system that has proven so many times in our recent past that it is not there to serve its employers( the people), but instead serves party members, first and foremost. By the way, that membership amounts to less than 2% of the population. So, what gives? How can a minority (i.e.: political parties and their membership) hold up the majority of the people in this province/nation? How was this achieved?

Liberals and CONservatives all dance together and, no matter how you look at them, they cater to the business community which has very much become an integrated part and power base of these parties.

The NDP, in an effort to distinguish itself from the Liberals and CONservatives has aligned itself with the trade unions which, if you remember what we said a few paragraphs back, has tied any open ends by its tight association with the government employee unions ... from which it derives handsome annual salaries for those trade union leaders who also happen to support the NDP party.

One can only be of the opinion that if these political parties were to call for a full blown public inquiry looking into WCB and Community Services, they would be committing political (and financial) suicide. And, on close examination, one will conclude there are certainly no ideological differences in any of these parties who have become an expensive albatross around the necks of Nova Scotian taxpayers.

The Canadian media are complicit in the abuse of injured workers and seem to be more interested in reporting on the government’s announcement of “their” new Canadian Human Rights Museum. This Museum is a disgrace and a slap in the face to every injured worker, whose rights were removed back in 1914, with a stroke of a pen and the signature that best represents a hypocrite, is that of the Union, who sold out every working man and women in Canada when they signed that document, (Meredith Agreement).

According to this logic(?) then, those of us who do not belong to a union should still have our rights....no one signed anything on our behalf. So, why then are those of us who are injured workers (but were never a member of a union) be forced to accept a fradulent document we were never presented, for our approval. And, for that matter, who allowed this Meredith Agreement to supersede this NATION'S Human Rights Legislation?

Canadian Human Rights Museum Is A Sick Joke

The Canadian Government announced that they are opening up a, Canadian Human Rights Museum at a cost of over 265 million.

“This great national project will stand as a symbol for freedom, democracy, human rights and the rule of law,” said Prime Minister Stephen Harper who participated in the official groundbreaking of the new museum. “Working together, we are building a monument to Canada’s embrace of humanity’s highest ideals.”

Well the truth is, this is not the case and I am going to open the door to the truth and we will start with a statement recorded in Hansard in 1996, in the provincial legislature in British Columbia. Read Hansard 1996 in B.C.

Back in 1996 Liberal opposition critic for labour Linda Reid asked then Minister of Labour for B.C., N.D.P. Minister Moe Sihota about the 191 injured workers who committed suicide while under the care of Worksafe B.C... Apparently Moe was of the understanding that the number he had was 0.1 percent, but nevertheless it was acknowledged in the Provincial Legislature of B.C., that injured workers are committing suicide.

To day the MLA: Hon. Linda Reid sits on the Governing side of the B.C. Legislature as Minister of State for Childcare. Maybe the Hon.Linda Reid can look into how many children live in poverty, because of that vile bad faith Workers Compensation Legislation?

We also know from reading through all the provincial government reviews of the Workers Compensation Boards in Canada, that these provincial boards act in bad faith, we also know that injured workers live under the constant threat of being terminated off benefits and we know that they are intimidated by the words "Non Compliant" , and these words are used by the WCB Hired Therapists .

My point is this, regardless of the number debated by Liberal Linda Reid and N.D.P Moe Sihota in 1996 it was established, that injured workers in British Columbia are committing suicide at a high rate. We also know that the constant intimidation tactics used by the WCB Boards hired therapists is a contributing factor. Keep in mind that what is taking place here is cruel and on usually punishment, that can only be called one thing, legislated mental cruelty.

What else can you call it , when WCB staff and health care providers are provided with legislated protection and according to the WCB Legislation, they cannot be called before the courts to answer or be held accountable for their bad faith and abuse of power, which they administer on the very people they are suppose to protect?

So what were the numbers in 1996 for all the other provinces where injured workers were committing suicide while under the care of the WCB Legislation? And what are the numbers to date?

Now tell me that Canada is a supporter of Human Rights , when it is a well known fact that injured workers are having their lives destroyed by a piece of legislation that does little else except legalize murder. Yes that is correct; Canada Workers Compensation Legislation and system is nothing more than legalized murder. But how many more injured workers in Canada and their families were forced into bankruptcy, because of this bad faith law, and how many families were split apart?

Here is proof that injured workers are not protected under the Human Rights Act or the Canadian Charter of Rights and Freedoms. Injured workers cannot get a lawyer in Canada to take their case before the Supreme Court of Canada, you see , Human Rights is only afforded to those who have the money to buy it. Human Rights as it is dealt with to day pertains to , color, race and gender... so why not injured workers? Aren't we already classified by law a group of people in the minority? So, why are we further disadvantage , by a law called the Workers Compensation Law?

We will be posting more. It is a safe bet that thousands of injured workers were forced into suicide over the years because of the intimidation tactics of everyone of these Workers Compensation Boards here in Canada. It is a safe bet that every political party played a major role in covering up the truth, and it should be noted that every business in Canada who finances this vile Compensation system share some of the responsibility since they receive the protection of these Bad Faith Government Boards.

I must agree with your remarks regarding Darrell Powell.position on the Union's representing WCB employees.They could and should insist WCB members of the Union stop participating in crimes against those disabled by occupation.
I was taken aback by Mr.Powell's failure to ask the Federal Politicians who appeared on his show more pertinent questions during the past election campain.I remember thinking while i was reading the transcript it should be Super Newf asking the questions.

You did not inform me of your intention to use my name or my involvement in any Senate Committee for shock affect. On previous communication I advised you to create a short synopsis, for your own benefit so as your story can easily understood.

It is becoming very clear that the Nova Scotia Department of Labour are the masters of abuse when it comes to the treatment of injured workers in Nova Scotia. This past month I have been contacted by injured workers who have proven to me that their children are suffering because the Nova Scotia Department of Labour, are to blame.

The Department of Labour and Workforce Development Deputy Minister: Margaret F. MacDonald can nolonger try to pass off the fact that they, are not in control of this Bad Faith legislation known as the WCB Act, because they are. It is the Department of Labour who are abusing injured workers in Nova Scotia and they are hiding behind their hired thug who are employed and protected under this vile piece of "government" legislation.

Next week I will be meeting with several families and hopefully we will have their children tell the public, how they suffered because of the abusive process of the Workers Compensation Board and those in charge. To think that this province is taking part in the United Nations Convention on the Rights of the Children here in Canada, when it is the Department of Labour who has been one of the worst offenders of the Rights of the Child.

This province has caused more harm and has destroyed more families than the public hear about, thanks to their Bad Faith Workers Compensation legislation. And all three political parties should be ashamed. Hopefully I can reach out to these injured workers and their children and that the children will launch legal action against the Department of Labour for their pain and suffering.

What is and has taken place here with respect to the WCB abuse is nothing short of a nazi crime and this province should be held accountable for letting these children suffer.While the children of those Government bureaucrats and politicians enjoy the finer things in life, the children of injured workers are forced to live in poverty.

Imagine, these clowns we call politicians had little problem spending $230, 000.00 on ATV's, while children of injured workers struggle to find a good meal.

The Star's Andrew Bailey has analyzed data on 650,000 worker injuries and illnesses between 2000 and 2007. Previous stories are available by clicking here. The WSIB fought the Star for two years. Eventually, the provincial agency gave us a snapshot of injury and illness claims records since 2000 but omitted names and other personal information. It also only gave us data on companies with more than five claims.

For today's stories, the Star interviewed injured workers, senior government officials, Ministry of Labour inspectors, company executives and many experts. Through a variety of other sources, the newspaper found individual cases where injuries were either hidden or downplayed.

The provincial government's highly touted campaign to improve workplace safety is rewarding companies for hiding injuries and rushing the wounded back to work.

A Toronto Star investigation has found that since 2000, companies have reported thousands of seriously injured Ontarians as having missed no time off work.

Some companies pressure or bribe workers not to report major injuries at all.

Some pay the wounded full salary to do degrading make-work jobs.

Others, such as construction giant Aecon Group Inc., have lied to make injuries look less serious.

The result is that companies cut costs under the Workplace Safety & Insurance Board's incentive plan.

The provincial agency's plan says that the faster a company gets an injured worker back to work, or off what is known as "loss time," the lower the insurance premium. Shortening this loss time or avoiding reporting it altogether can be lucrative, possibly leading to a rebate check from the WSIB.

The Star found that at least 11,000 worker injuries were downplayed or improperly handled over a seven-year period, including 3,000 fractures, dislocations, bad burns and other injuries, even amputations, that companies reported as resulting in not even one day off work.

These practices are dangerous because they give government an inflated sense of safety in Ontario workplaces. That's because Ministry of Labour inspectors rely, in part, on WSIB injury data to determine which companies to inspect. By downplaying serious injuries, unsafe companies may reduce the likelihood of an inspection. Meanwhile, many of the wounded have ended up pawns in a balance sheet game, shuffled back to work under the regulatory radar and vulnerable to further harm.

"It's not acceptable for any employer to force an injured worker back to work prematurely," said Ontario labour minister Brad Duguid when presented with the Star's findings. "There's no question the incentive program needs to be improved."

Candace Zinkweg, who worked on an auto parts assembly line, had to wear a sandwich board after suffering a repetitive strain injury that would eventually require surgery.

Another injured worker, after more than a decade of service butchering for a meatpacker, was offered a job watching trucks full of pigs roll in and out of the facility. "Hog Unloading Monitoring," the company called it.

Bum Sun Yoon's story (left) shows the extreme lengths a company will go to avoid reporting an employee is off work and recovering at home.

Board chair Steve Mahoney agrees there are problems with the incentive program but does not think it should be scrapped. The program is already under a year-long review after the Star found the WSIB was giving hefty rebates to companies found guilty of fatal safety violations.

He saidthe Star was unfairly blaming his organization and its 4,300 employees for the "anecdotal" bad behaviour of a few companies.

"To be perfectly blunt, I know your story is painting our entire system in a negative light and that bothers me a great deal. We make a million decisions a year. We spend hundreds of millions of dollars a year. I think this is a tremendous organization," he said, adding that the newspaper's investigation is a "terrible disservice to injured workers."

The problem Mahoney says is not widespread has touched his own board.

One of the WSIB's former board members, Mike Archambault, is the senior manager of safety for construction firm Aecon Group, which often wins multi-million-dollar contracts from the Ontario government. Earlier this year, Aecon pleaded guilty and was fined $125,000 after WSIB investigators found the firm lied about the amount of work time missed by several injured workers. In one case, a tunnel retaining wall partially collapsed on a worker in Toronto, seriously injuring his shoulder and back. The employee missed a week of work while Aecon said the man was back at work the day after the injury.

Archambault, who did not return phone calls to his Aecon office, left the WSIB board on April 2. The next day, Aecon signed a court document in which it admitted lying about injuries.

Aecon spokesperson Mitch Patten said Archambault's departure from the WSIB was unrelated to the guilty plea and that Archambault was not investigated. Patten added that Aecon has a reputation for safety and has improved its injury reporting since the offences he called "regrettable, embarrassing, wrong."

Here's how the injury reporting system is supposed to work:

An employer must, within three days, report an injury that causes a worker to need health care or miss work.

Once a claim is approved, the WSIB pays for medical expenses, typically 85 per cent of the worker's wage when time off work is necessary, and various other benefits that could kick in as a result of the injury. In exchange for paying premiums that fund the WSIB, companies are protected from worker lawsuits.

The WSIB says it is important employers report "loss-time" injuries so that the agency can make sure the injured worker is getting proper medical treatment and all his or her entitled benefits.

In addition to managing injury claims, the WSIB is also trying to make workplaces safer by encouraging companies to reduce injuries and work-related illnesses.

The WSIB relies on its graphic "Road to Zero" ad campaign that warns of fatal risks in the workplace. One ad depicts a chef, her face boiling after a vat of hot liquid spills on her head. Another shows a tradesman plummeting from a building into the windshield of a dump truck.

The incentive program is supposed to help, too, by giving rebates to companies that have made workplaces safer and levying surcharges to encourage unsafe workplaces into improving.

The program places a heavy emphasis on reducing "loss-time" injuries – that is, injuries that cause a worker to miss at least one shift of work. The WSIB considers such injuries a sign of an unsafe workplace.

The longer a loss-time injury persists and the prospect of future claim cost grows, the greater the expense to the company.

After Zinkweg got hurt, her boss at Pivotal Action Force temp agency told her to go curbside wearing a sandwich board advertising the agency. Until her injury, Zinkweg used a staple gun-type device to upholster car seats on an assembly line. She said the job put constant pressure on her right arm, from her fingers up to her shoulder. She developed what one doctor described as a "substantial" case of carpal tunnel syndrome.

Draped in the sandwich board, walking up and down the sidewalk in front of the temp agency on a recent afternoon, Zinkweg said, "This is humiliating. This has to stop."

Pivotal Action CEO Alan Kouba said wearing the sandwich board is valuable to the company because it attracts potential employees. Kouba said the WSIB ruled the sandwich board job "appropriate and suitable." He said it posed no health risk to a worker with injured arms.

"We have an exemplary record. We've received a rebate every year (from the WSIB)," Kouba said. "We are trying to limit our costs, but not at the expense of the (WSIB) or our employees."

The WSIB and labour ministry claim they are marching in lockstep on the Road to Zero, with the two agencies citing a dramatic 20 per cent decrease in workplace injuries since 2004 that resulted in companies saving billions of dollars.

But the 20 per cent reduction only refers to injuries that result in a worker missing time from work; Ontario companies have reported 50,000 fewer such injuries in the last four years.

The government statistic does not count the 3,000 serious injuries the Star found companies had reported as resulting in not even one day off work.

In addition to fractures and dislocations, the 3,000 injuries included amputated fingertips, cases of welder's flash, rotator cuff tears and crushing injuries.

Bryan Evans, a Ryerson University professor who until 2003 managed a WSIB department responsible for analyzing claims data, said these injuries should be resulting in time off work.

"It's not rocket science," he said. "Those are traumatic injuries."

About 8,000 workers suffered from equally serious injuries and long-term illnesses, such as post-traumatic stress disorder, and missed a partial shift or one work day.

One of the large employers that reported several serious injuries resulting in no loss time is Staffing Edge, a Brampton-based temp agency. Since 2000, WSIB data shows Staffing Edge employees suffered 10 fractures, three intracranial injuries, three crushing injuries, two concussions and one fingertip amputation, and not one day of work was missed.

Chief financial officer Victor Winney said a loss-time claim can be expensive and that the WSIB pushes companies like his to give the wounded work as soon as possible.

"If the (WSIB) pays the worker a dollar, it will cost (the company) five – that's just rough numbers. You're going to pay more," he said. "I have guys doing quality work on ensuring bolts are the right size, the right weight, sitting at a bench. (With) a broken femur, eventually when he's in a healing process, he could do that bolt job. His leg has to be elevated, yes, sometimes he needs to do special exercises to take care of the injury."

The Star found the WSIB's policy around "early and safe return to work" is loosely defined – companies often get to decide which jobs are suitable.

At Mississauga-based Purolator Courier, where 14 fractures, three intracranial injuries, four crushing injuries, one dislocation and three concussions have been reported as resulting in no time off work, human resources director Doug Kube says his company is following WSIB rules.

"It's not unusual that (a worker) may have something like a broken ankle, that they could do paperwork audits, administrative duties in an office, and sitting in a chair with their foot elevated and working at a computer," Kube said. "That's not unusual."

The WSIB tells the Star it is working on improving the return-to-work process and has created two new positions that will, starting this fall, help workplaces better understand the concept of a "suitable and productive" modified job.

Since 2000, grocery store chain A&P has reported 15 serious injuries that resulted in no time off work, including six fractures.

The company has an uncommon approach to dealing with some of its injured workers. A&P runs two "return to work" centres, one in an industrial strip mall in Mississauga and another in London.

A spokesperson said injured workers go to these centres to perform modified work such as "creating gift baskets" and "receiving/recording company documentation." The spokesperson said the work "is important work that would otherwise be done at the store level or head office, if the centres didn't exist." Each centre has a cot for workers not feeling well. The company would not allow a reporter to tour a centre or talk to workers on site.

As for the 15 serious injuries reported since 2000, the company says the injuries were either not serious or incorrectly catalogued by the WSIB. In addition to the broken bones, the injuries also included one dislocation, three crushing injuries and two cases of what the WSIB calls "traumatic" tendonitis.

Steering companies down the WSIB's profitable "Road to Zero" injuries is a cottage industry of consultants who teach how to work the system. Online, they boast about millions of dollars in workplace insurance costs saved. They advise bosses on how to most quickly get a wounded worker back on the job. They sell their commitment to fight claims.

One consultant told the Star that unless "totally disabled," a worker should be able to do something "meaningful," like "answering a phone or shredding paper."

Another, on his company's website, posted a "supervisor's checklist" for employers that advises offering a modified job even before a medical diagnosis is available. Consultant Dr. Edward Gardiner explained: "WSIB expects us to do that. WSIB wants us to offer early and safe return to work as soon as we can. I think most people want to come back to work."

The Star shared its findings with three Ministry of Labour inspectors, including one high-ranking inspector, and others with knowledge of workplace safety issues in Ontario, and none was surprised.

The inspectors, who requested anonymity for fear of losing their jobs, say the WSIB and labour ministry allow companies to hide dangerous workplaces and cut costs at the expense of injured workers.

"We're still seeing injuries," said one inspector. "We're still seeing the same stupid things being repeated over and over."

The government's investigative files show many cases of companies failing to report accidents at all.

One high-profile WSIB prosecution involved retail giant Wal-Mart. In 2005, it pleaded guilty to 25 counts of failing to report an injury, and was fined $500,000. The company said some store managers tried to report injuries but used the wrong fax number, and it has improved its reporting system.

It is impossible to tell if these cases of non-reporting shed only a sliver of light on the problem or if government inspectors are catching all offenders. There are millions of workers in Ontario covered by the WSIB – from grocers to autoworkers to temps. The WSIB has 19 inspectors to complement the ministry of labour's 430 – that's about 450 to patrol the 230,000 companies covered by the WSIB.

What happened

Bum Sun Yoon slipped between a delivery truck and loading dock, his fall brought to a bloody halt.

"I fall down in the gap. My two balls hit, too much bleeding from my penis. I was shocked," said Yoon in broken English.

A new arrival to Canada, the native of South Korea was rushed to hospital. He was worried about permanent damage. But his boss at a Toronto company had other concerns.

"I can't work. I got injured. Badly injured," Yoon said. "The next day they call me and say `How about you go to work?'"

A week after the injury, as Yoon continued his recovery at home, a manager at the company, TIPS Inc., asked Yoon to sign a letter to the WSIB saying he did not wish to make a claim. In return, Yoon was paid $1,000 for his time off.

"A manager told me if I make trouble bad things will happen to me. I'm an immigrant. I don't know anything," said Yoon, now a part-time dishwasher at a Swiss Chalet.

The letter reads: "I, Bum Sun Yoon, wish not to file a claim ... for the injury sustained." The document he signed is a form letter. Another TIPS employee injured in a workplace accident signed a similar letter.

The WSIB classified the injury as "No Lost Time." The fraudulent reporting was uncovered after an unrelated accident that left five TIPS employees dead. There was an investigation and WSIB fined the employer $5 million. The company folded.

Company response

TIPS' former president David Burleigh agreed Yoon's case amounted to "a shuffling of the deck of cards. I wasn't the one who (said) let's pay this fellow and tell him to be quiet. That appalls me that we even would have done that. (Mr. Yoon) is someone we definitely should have had as a loss-time injury," Burleigh said, adding, "If the incentives to hide these things would go away, the proper reporting would happen for the employees."

What happened

Li Yan Chan gingerly unfolded a creased, lined piece of paper, her left thumb shaking involuntarily. In Cantonese, she read from her own handwriting:

"All the vegetables come in either boxes or bags. Every day I have to cut the following: First, onions, two bags, each bag 50 pounds. I have to cut carrots, one bag, 50 pounds. Green onions, two boxes, each box 20 pounds. Broccoli, I have to cut six boxes, each box 30 pounds ..."

Chan worked in the kitchen of a Mandarin restaurant at Yonge St. and Eglinton Ave., until spring, 2004 when pain in her hands and arms made the job unbearable. Four years later, she can barely open her purse.

"Every week I had to work 60 hours. Every day I work very fast to complete my work," she said through an interpreter. Chan said she did as her boss told her and did not report her crippled hands to the WSIB. "My boss told me to go see a doctor and don't tell him it's caused by the job. He said worker's compensation is very complicated, so much hassle.

Her injury did not improve. Chan says her boss told her to go on unemployment and to come back when healthy.

"At that time, I'm a newcomer ... I know nothing about Canada. The employer was not being honest."

When Chan, now 52, went on welfare, taxpayers, not Mandarin, began paying for her disability.

About a year later, an acquaintance told Chan the WSIB may compensate her for her injury. So Chan reported it and now receives some benefits.

Company response

Mandarin executive Allan Chow says Chan was "let go" after telling a manager she was "tired" by the physically demanding job. Chow said he did not know if the manager ordered Chan not to file a claim. "I cannot deny (managers) make some mistakes. My position is to tell them how the system works," he said, adding that it is company policy to properly report all injuries.

The same situation exists in every WCB system and the findings of Mr. Bruser is known and condoned by all Governments as well as all workers compensation systems. Every one knows that all workers compensation systems are nothing more than organized crime. The Government will go to great lengths to prosecute workers for alleged fraud, yet there is little doubt that criminal acts by employers will not result in criminal charges. Employers who offer modified work when a worker is injured is nothing more than a joke as in nearly all cases the modified work is never investigated by WCB as to the suitability of the work or even if it is safe for an injured worker to perform. Does this story surprise anyone? If it does, they must be living on another planet as there have been numerous other investigations as to under reporting and they all have reached the same conclusion.

When the big "government unions become the abuser."

You remember Cher. She survived Sonny and his eventual death. Her song, “If I Could Turn Back Time” was, somehow, an acknowledgement of the negative realities that influence our lives and over which we have little or no control, lately.

In the dark days before the Depression in the “Dirty Thirties”, there was a definite place for unionization in all sectors of the work force. Something had to be done to curb the use and abuse of workers by those employers who took every opportunity to exploit, and profit from the sweat of the people who dug the coal, lifted the freight, made the steel and contributed to the growth of wealth in this country.

In those days, too, when an injured worker suddenly became a burden … and no longer useful to the employer who had exploited their efforts, they were simply relegated to the scrap heap, like so much useless slag.

In Nova Scotia, the owners of coal mines and the steel foundries were just as good at wringing every last dollar’s worth of productivity out of a worker as the rich industrialists in the U.S. and the U.K. There were riots in Cape Breton in the 30s … where workers who had decided they had had enough, rebelled and fought back, as they attempted to unionize. Some paid the ultimate price for their convictions and died in their struggle.

Miners and steelworkers in Cape Breton, before unions, were indentured to their employers … who owned the homes they lived in and provided the groceries their families purchased on credit from the “company store”.

A miner who was severely injured or killed, and, consequently couldn’t work, not only had his life ruined but that of his family as well. It was not inconceivable for a miner’s family to be without income, food or a roof over their head.

Something had to be done to improve the conditions of working people, everywhere.

Some sort of real power was needed to fight back and bring errant employers to heel.

In those days, the answer was the UNION. “All for one and … one for all.” Everyone paid “union dues” into the strike fund pot … so members would have the bare necessities of life if they had to go out on strike while negotiating with those errant employers.

Unions were driven by a sense of fairness and humanity, then.

Fast forward to the 50s when the high ideals of unions everywhere became watered down and, in some instances, corrupted by organized crime and the smell of money. Money and power have always gone hand in hand … and there was money to be made through the union vehicle.

Things started to change for all workers in general as they were exploited by other, newer players, as well.

Injured workers, in particular, were confronted with their own set of circumstances when their abuse came, not from the employers, like in the old days, but from organizations like the WCB, governments, and, surprisingly, UNIONS.

Those same unions that had once been the saviour to working men and women everywhere, had now become a very large part of the problem. For injured workers, especially, the unions themselves have done much to wind the clock backwards to those days, before the Depression, when a man who couldn’t work ran the risk of losing everything.

EVERYTHING!

How is it that injured workers should lose the solidarity of their union brothers and sisters when they become injured and are abused by the aforementioned WCB?

It’s the MONEY, stupid!

Quite simply, the story here exemplifies the fundamental switch, that has taken place on the part of the unions, to “forget”, if not totally disavow the plight of injured workers who formerly paid their “dues” and, sometimes, were pushed into union membership as a condition of employment.

Based on this story, it should become readily apparent to anyone with a functioning brain, that there is an obvious conflict of interest going on here that no one is prepared to address … and has relegated unions to nothing more than another means to providing higher salaries to the union leaders and organizers than those earned by workers who are required to support them.

Unions have awarded themselves a “licence to print money” destined to pay union leaders who are prepared to let their injured workers twist in the wind … thus exacerbating the plight of injured workers who must try to deal with those UNIONIZED WORKERS who work for the WCB as well as those of the provincial government who are covered under separate contracts as members of the NSGEU.

Injured workers have been sold out by their former unions who are reluctant to question or buck the actions of other union members who work for the WCB and Nova Scotia government.

Injured workers couldn’t win if they tried … with that kind of a deck stacked against them.

Unions, long ago, apparently decided to sell their souls … at the expense of injured workers who were lead to believe they could rely on them (the unions) in a time of need.

After all, they had been good union members, prior to their injuries, and faithfully paid their union dues … so, why are they abandoned by their unions when they can’t work because of injury?

It’s the MONEY, stupid! Injured workers don’t get paid for being out of work.

They don’t pay union dues, either.

Do you think that this could be the cause for apathy on the part of the unions toward injured workers?

Union membership no longer control their unions. They are now controlled and directed by big law firms employed by union leaders. Again, there is a parallel between power being concentrated in a few hands at the top in the unions, just like the electorate is losing ground in exercising control over their governments. Does anyone remember Buzz Hargrove placing a CAW leather jacket on the back of Paul Martin during his election campaign that failed to return his government?

Union “solidarity” ends around the same time as the injured worker’s last pay cheque.

Once again, we have another example of a “protection racket” gone awry … it only exists as long as there is money to be made.

Unions, today, have become very political … in the worst sense of that word … and reflect the lack of moral and ethical character of their leaders and organizers who pay themselves very well … while not performing up to the standards they established back in the 30s. There is a parallel that can be drawn between unions and political parties today. Both are under the scrutiny of an increasingly jaded public who doesn’t like what it sees.

Like politicians and political parties, unions talk a good game but no longer have any will, or perhaps, the ability, to do the job they signed on to do.

John could take no more WCB abuse or their intimidation

This was one of the hardest interviews I ever had with a family of an injured worker. You see he resorted to taking his own life, all because he could no longer take the cruel treatment of the Workers Compensation Board. His widow told me the abusive WCB process was worse than the pain from his injuries, she said it was constant intimidation, informing him he was going to be cut off benefits and that was one promise they did keep.

The reason it was so difficult for me, his widow opened up a photo album and commenced showing me the life she and her husband had before his workplace accident. The last two pages were about his death and how it ended.She wanted you to see for yourself.

This is how it ended, at their summer cottage,in 2006. His compensation pain ended.
We were asked by John's family to obscure his face a bit as this memory is still painful . In accordance with their wishes we have done so.

This my fellow Nova Scotian’s and Canadians, his how John ended his life and all because his caseworker decided she had every right to over rule the medical evidence provided by three attending physicians . Oh yes , John’s widow did end up with a payout , but only because John’s doctors threatened to go public and hold a news conference.

John’s widow is remarried now, but she did offer me this picture today to post on my site and it is her wish that more families come forward and tell their story about how they suffered at the hands of the WCB. She knows for a fact that there are many more just like her husband who has committed suicide while in the WCB Program .

I intend to meet again with John's widow, because you haven't heard the complete story on this one yet. His widow tells me that the documents in her husband's file speak for themselves.... volumes , in fact, of how her husband was used and abused by the WCB ... and she wants everyone to see the facts.

I can't help thinking that the WCB reminds me of the worst pedophile ... who doesn't want anyone to know who they really are and how they treat others.
The secrecy is ending right here .... right now.

WCB's Nancy MacCready-Williams … DUBIOUS DISTINCTION

There was a time when, to be a recipient of a meritorious award, it meant someone was being singled out for their bravery, good deeds or heroism … laudable efforts worthy of high praise for someone who had gone above and beyond to achieve something out of the ordinary on behalf of his fellow man.

Martha Stewart, in her laconic style, might call this award “A good thing”, without knowing the facts.

In Nova Scotia, “laudable” was twisted into “laughable” by the Atlantic Business Magazine who recently decided to recognize Nancy MacCready-Williams, the current CEO of one of the most fraudulent organizations ever to be legitimized by current and past governments of this province, for her work.

In this instance, though, the award is laughable when one considers the context within which it was earned … there is nothing worthy of laughter here. Tears and anger are more apropos for such shameful achievements.

I don’t recall Dr. Josef Mengele ever being awarded the Nobel Prize for his discoveries in medicine … as the result of experiments conducted on hapless inmates of Auschwitz.And, certainly, Osama Bin Ladan is a doubtful choice for any humanitarian awards from B’nai Brith.

So, why in hell did the business community in Nova Scotia second an award to the head of Nova Scotia Workers Compensation Board as one of Atlantic Canada’s Top CEO’s?

Curiosity causes one to wonder what criteria were used in the selection process. Was Ms MacCready-Williams adjudicated simply on the number of claimants denied, or, more particularly, on the numbers of dollars snatched from the hands of those injured and dead that were unfortunate enough to have WCB “coverage” through their employers?

Any other reason is superfluous when one considers the history of the WCB in Nova Scotia and how it has developed its doubtful reputation ( deserved) for its (less than fair) dealings with claimants.

Or, perhaps, the award is based on WCB efforts and abilities to destroy the lives of injured workers and their dependants? Or is there a separate category for this achievement? Certainly, some credit should be awarded for WCB efforts at building their numbers of bankrupted and foreclosed claimants who had looked to their organization for an income. Better yet, how about the numbers of suicides instigated by their arbitrary denials to claimants? Surely, that success must be worthy of an award.

We have here an agency (of the government, mind you) that exists for itself, apparently. Hundreds of MILLIONS in its bank accounts being added to each time the WCB manages to deny an injured worker what is lawfully and morally his/her due.

This is fraud of the first order … duping workers out of their legal rights while protecting employers from legal action because they pay an “insurance premium” … collected, supposedly, to “cover” the very same workers the WCB takes exemplary effort in denying. This, then, begs the question as to where the distinction lies between what role the WCB performs … as compared to any one of a number of “protection rackets” owned and operated by Organized Crime … who, likewise, have no compunction in making money at the expense of the dead and injured.

Recently, the Nova Scotia WCB was roundly criticized for the way it does business by none other than James Dorsey, Q.C., a lawyer from B.C. who specializes in this area of the law. He made no bones about those improvements he felt should be made, posthaste, to make this vile agency into something acting more fairly and equitably with injured claimants. This, in spite of the fact he was paid part of the 2.5 million dollars (your tax dollars, again) to render an “objective” summation of WCB practices. His conclusions were not what the government expected or wanted to hear, evidently.

Sad but true ...and, always "legal"... these legislated employer insurance providers, (W.C.B. Boards) are well known for their demonstrated incompetence, mismanagement, bungling, deceit, apathy, political meddling,( all expressed in the Dorsey Report) and their obvious bad faith actions ... excused and masked as innocent omissions while, in reality demonstrating the worst kind of cynicism and hypocrisy.

To date, none of his recommendations have been implemented voluntarily and the government of the day has not pushed either …indicating its lack of political will and disdain for ethics, as usual.

The organization (WCB) continues, without compunction, to deny deserving claimants their legal and moral rights … with tacit approval from a government that continually coddles the business community with handouts from tax coffers while keeping a blind eye to WCB practices.

Perhaps, given the input from the government and cooperation from government unions, Nancy MacCready-Williams should share her award.

MacDonald’s Minister of Labour, Mark Parent … CYNICAL HYPOCRITE

Is there any limit to the depths to which the Rodney MacDonald CONservatives will go in attempting to paint themselves as compassionate and caring?

The answer is NO … these people are the lowest of the low … prepared to do anything, no matter how reprehensible, to make themselves look good … when their history shows everything else but.

A good case in point is their exploitation of the accidental death of Jamie Lapierre … whose work-related death was the result of what can best be described as laxity on the part of his former employer for not caring enough to ensure no one would have to pay with their life to do the job required.

With all respect for Jamie Lapierre, and the friends and family who publicly mourn his death and the loss of his friendship every time this sacrilege to his memory is aired, one cannot help but ask WHY.

Why has this MacDonald government spent at least 10,000 of your tax dollars to produce a piece remembering Jamie Lapierre, while the Workers’ Compensation Board, with which this government works hand in glove, through the Department of Labour, has chosen to sweep other injured workers under the rug ?

Can it be that Jamie Lapierre , because he is dead, has been impressed into becoming Rodney MacDonald’s Horst Wesse l… such as Goebbels used so effectively to get the German people behind his leader, Adolph Hitler? It sure looks that way to anyone who has studied WW II history … another example of a shameless propaganda machine that will do anything, no matter how cheap, to gild the MacDonald lily.

To clarify, we are not equating Jamie Lapierre, in any way, with Horst Wessel … an undeserving Nazi thug, who, nevertheless, was utilized by propagandists to focus and manipulate German public opinion using subtle, emotional, appeals to his countrymen’s human spirit. We merely cite this memory to illustrate how Jamie Lapierre has similarly been used to achieve a particular end … as are caring Nova Scotians … who don’t know they are being “fiddled” by the Rodney MacDonald crowd in a cynical, contrived attempt to humanize themselves, using a similar psychology … while they know full well they could never qualify, based on the truth of their actions.

Mark Parent, a Baptist Minister in “real” life, had to have had final approval on the production costs of these spots, as well as approving the content and costs for air time. Somewhere along the way, “Reverend” Parent has lost sight of his religious humanitarianism … and has replaced that value with crass political opportunism on behalf of the Conservative Party of Nova Scotia. Like the old Broadway song says, “Anything Goes ”… especially when it comes to politicians attempting to curry favor with malleable Nova Scotians.

Once again, shades of Orwell’s “1984” rear its head in the worst possible scenario.

How is it that the Government of Nova Scotia is so keen to remember Jamie Lapierre … while totally forgetting Alfred Gordon Taylor?

The answer is simple, Alfred Taylor was handed a death sentence by the WCB who wrongly convicted him of “not qualifying” for the benefits they denied him as an injured worker. Certainly, a death penalty exists in Canada … and, the WCB decides who is guilty.

Alfred Gordon Taylor had a life, too. This steelworker from Windsor, Hants County (Nova Scotia) was jerked around by the WCB who arbitrarily denied this man his rights … but not before they strung him along and made him believe it was just a matter of time before he would begin to receive his benefit cheques as an injured worker.

How about Alfred Taylor’s wife, who came home one day to find her husband out in the garage where he hung himself, as a final act of despondency …, clutching the letter he had gotten from the WCB that day … a letter that denied him any and all compensation.

There are those that will extol the virtues of the WCB … we just aren’t one of those … on the payroll.

Sure, the WCB is compassionate and caring. Eighteen months after Alfred Taylor was in the ground, his widow, Joan, became a witness to their largesse.

It seems that the WCB had been in “error”, and, in a fit of conscience, they sent her their cheque for the grand sum of an amount slightly over eight thousand dollars.

This is the value of a man’s life?

How about Joan Taylor’s tears? What about Alfred Taylor’s son?

IMAGINE … YOUR FATHER IS NOT WORTH ANY MORE THAN EIGHT THOUSAND, LOUSY DOLLARS!

The odds are pretty good that Alf Taylor’s life will never rate a TV “memorial”, played innumerable times each night ( paid for by your tax dollars), showing his family and friends in tears … with the implied compassion and empathy of Minister Mark Parent … and the vile system he is so willing to be part of.

This “resolution” proffered by Michael Baker a couple of years ago, epitomizes the cynicism and hypocrisy of this, and past provincial governments in Nova Scotia.

As you read, give your thoughts to Alfred Gordon Taylor and all those other injured workers who have been abused and thrown away by the government and its friends who make up the Workman’s Compensation Board … and, please, do your best not to throw up in front of everybody…

Whereas the Day of Mourning, which is held on April 28th each year,commemorates all workers who have died on the job in the past year.

Hello! We are Calling on the Canadian Parliament and Senate.

Dear Elected Members of Parliament:

When you have your health you don’t have a worry in the world about injured workers!
… until you become one. Then your injury becomes your life, or what's left of it.

As an injured worker, it is then that you become cognizant of how unimportant you become to the politicians you call upon to help you navigate through the gauntlet of garbage thrown up by the Workers’ Compensation Board (WCB) that managed to get Royal Assent from Nova Scotia government as a legal entity … ostensibly as an objective “insurer” whose aim was to indemnify injured workers while negating any move on the part of those workers who might intend to sue an employer for negligence.

As is usual these days, the lofty purposes for being the WCB have been prostituted and bastardized into the most reprehensible of organizations who insures that contributing employers are not sued, for sure … while amassing millions of dollars in WCB coffers, as injured workers are defrauded and intimidated out of monies they are rightfully and morally due.

The provincial government is complicit … and has been from the inception of the WCB, by turning a blind eye to the most vile practices ever perpetrated on any human being at the most vulnerable time in their lives.

Where is the support for these former union members who were, as a requirement of employment, told they must pay union membership “dues” to work … and their union would “protect their interests “ when dealing with employers. The sub-text not mentioned by the trade unions is this: If you are injured and unable to work … and CONTINUE to pay dues … your value to the union then becomes ZERO. You don’t count anymore … not that you ever did to begin with.

The important thing is that Joan Jessome and her union NSGEU officials will continue to receive their high salaries and perks, as will those officials in CUPE.

Much like the politicians I mentioned earlier … who really don’t give a rat’s ass for the plight of injured workers who can’t work at their former employment. In fact, many of them can’t work at all … the result is NO income.

You would have to be a politician or union rep … or worse, a lawyer, to realize that if you are unable to work, because of having received injuries so severe on your last job, that you will not have any MONEY coming in and, consequently, will not eat. In the worst scenarios I know of, men and women will lose the roof over their heads, the food in their bellies and the car to get them to the WCB-appointed ( or owned) doctors who have been ordained to deny their claims.

Marriages have been ruined … no problem for the WCB and their cadre of doctors and lawyers. In fact, the WCB is overjoyed when injured workers give up all hope after being interminably jerked around by these heartless bastards … and commit suicide. Problem solved.

Where is the media in all of this, you might well ask. Silent. Unsupportive. Apathetic. The fact is, the WCB, the various unions and the various levels of government talk a good game … if they talk at all.

From the standpoint of the media, an injured worker getting the shaft from a cruel and manipulative bureaucracy isn’t “news”. The day some poor injured worker walks into a WCB office with a shotgun and starts randomly shooting because they are at the end of their rope, the media might take an interest and run with it for two days.

The rest of the time forget it . The mainstream media is not about to have law suits thrown at it for the sake of some injured worker who is the victim of the worst fraud anyone should ever have to deal with. Lawyers from the WCB will threaten and intimidate … they’ll shut up. Doctors will commit perjury and swear there is nothing wrong with a claimant … while denying to themselves they are not in violation of their Hippocratic Oath.

No media outlet will ever be too critical of unions, either. Their unions could apply pressure and/or put them out of business under the right circumstances. Someone would lose a lot of money. Over an injured worker? No way.

So, here I am advocating for the injured worker … as a humanitarian … an injured worker who appreciates what other injured workers go through every day while fighting for their survival. I don’t get paid anything. I’m not looking for anything, other than the feeling that, one day, injured workers will be treated fairly and honestly … with compassion by people whose only concern, so far, is how many dollars they can make from some poor bugger’s misery. CRIMINAL ?

Imagine voting for a person who has made the lives of so many,so very miserable and then learn that that person would never be held accountable. Well how about this little lady. Maria Minna, PC, MP, (born March 14, 1948, Pofi, Italy) is a Canadian politician who represents the Toronto riding of Beaches—East York in the House of Commons for the Liberal Party.

A public policy consultant by profession, Minna was appointed Vice-Chair of the Worker's Compensation Board of Ontario's Task Force on Rehabilitation in 1986. She held public hearings across Ontario and delivered a hard-hitting report that resulted in significant improvements to the manner in which injured workers were treated.

In 1991, she was appointed Chair of the WCB Task Force on Service Delivery. She interviewed senior management and front-line personnel across Ontario and delivered a report that resulted in significant improvement in the delivery of services to WCB clients and the elimination of waste. Maria Minna delivered for the WCB clients and those clients are the people who own and finance these vile Boards, keep in mind injured workers are not the clients of these WCB Boards, we are the abused victims. Please read on and understand those people you elect, click on her name, read about her great work. Hon. Maria Minna No wonder politicians in Ottawa aren't interested in ending the Workers Compensation Abuse... they are managing it .

Ottawa Complicit in the WCB Experience Rebate Rating Program

The Federal Governments Website Entreprises Canada, is a propnent of the Experience Rating Rebate programs run by the WCB Boards in Canada. It is without question, that the Canadian Government are a complicit stakeholder with all Workers Compensation Boards and tacitly endorse the actions of all their partner WCB Boards, therefore the Federal Government is breaching it's own Charter of Rights and its own Human Rights Laws.

Injured workers across Canada would like the Federal Government, through the Federal Minister of Labour to call for a committee to be struck, to investigate the many acts of Bad Faith demonistrated by their partners, the Workers Compensation Boards within Canada.

Dear Sir:

The New Democratic Party is not the working man or woman’s party, the NDP segregate and discriminate when it come to representation in either the Provincial Legislature or in the House of Commons . The New Democratic Party mislead voters when it comes to calling themselves the peoples party, when in fact they are the party of the unions. Much like the Liberal and Conservatives are the party of business. I have learned that there is no such thing as a people party , but instead , we have parties party.

I was employed with one of the labour organization as a statistical researcher, there were several similar researchers with other labour federations , all of us were collecting information for the New Democratic Party, provincially and nationally.

We ran surveys to find out if the membership were happy with the New Democratic Party, we also ran a survey to check out how the Workers Compensation System across Canada was treating injured workers, mainly former unionized member. I say former members simply because 99% of all unionized members are dropped because they cannot afford to pay dues if they cannot return to work, taking into consideration they were either denied or terminated from these Workers Compensation Boards, even though they were medically credited with being disabled.

The bottom line is unions truly careless about their former injured members, except for the occasional few who were good at showing up to a protest or to support the New Democratic Party candidate. In other words your first loyalty had to be to the union and if the union liked you, well they could usually pull a few strings with one of the W.C.B’ s unionized staff or caseworkers. It has little to do with being disabled when it comes to making it onto the benefit roster of the Workers Compensation system without a fight, it is usually done under the table with union connection. And since every unionized WCB has a union representative sitting on the Board of Directors, need I say more?

Now there is little I can do to help, but I can assure you, that unions and the New Democratic Party play a role in messing with the lives of injured workers , neither practice what they preach. Unions sit on every single W.C.B board as you have mentioned Wayne, so if they wanted to clean up the abuse and the bad faith these boards are noted for , the unions and their political partner the New Democratic Party could, so why haven’t they?

I must say Mr. Coady you are doing a good job informing the injured workers about union involvement in these Worker Compensation Boards. Keep up the fight. Hopefully Ottawa will strike a Senate Committee to look into the entire Workers Compensation System. There is no question that abuse and bad faith exists, within all of these boards, so what is both levels of government afraid of?

The ironic side to this story about the WSIB rebate program in Ontario is the Unions are every bit as guilty as "government" and business ,when it come to acting in Bad Faith.

I am sick and tired of the labour movement here in Canada blowing smoke out their backside and finger pointing at everyone else involved in the abuse of injured workers and workplace safety, when they are complicit. These organization like the Canadian Labour Congress and their offspring chapters, the Federations of Labour, have union representation on all Workers Compensation Boards in Canada, they must approve what the WCB administers, should it be abuse directed at the injured worker or one of the many acts of Bad Faith.

If the President of the Ontario Federation of Labour Mr. Wayne Samuelson and all other Labour Federations in Canada want to send a message that Labour is not happy with the abusive process and the many acts of “BAD FAITH “ which these compensation boards are well noted for, then pull out of these boards. Why would any Union, want to sit on a Board or Committee that is known for its abuse?

The Federal Government can intervine in every one of these WCB Boards, simply because they are a stakeholder partner... they do receive the protection of the WCB Act ...they are an employer too! So, why is it our elected MP's use the excuse that the Federal Government has no jurisdiction over these WCB Boards, they are a partner by association.

Injured Workers Call On Business Organizations, like CFIB

Injured workers in Nova Scotia and across Canada appeal to the membership of the Canadian Chamber of Commerce and The Canadian Federation of Independent Small Business to return to injured workers their rights, that they have had taken away by "your" insurance provider, the Workers Compensation Boards in Canada. We want; the right to be treated as every other Canadian citizen is, according to section 15.1 of the Charter of Rights and Freedoms.

This is a letter addressed to me, Wayne Coady from the law firm Stewart McKelvey Stirling Scales .... confirming injured workers have no rights when it comes to bringing civil action against employers. In other words we are not only disadvantaged because of our injuries ...but we are further disadvantaged because of this "BAD FAITH LAW" called the Workers Compensation Act. This has to be the lowest form of discrimination place upon humans in a "civil society" .Please read the letter HERE.

I have many more similar letters whereby the business community take great pleasure through their lawyers informing me that injured workers have no rights. Imagine that... we the injured worker is more likely to be discriminated against, not because of race or color, but simply because we are a victim of a workplace accident, so does that make us lesser citizens, than those of a different race or color, who are protected by the Canadian Charter? .

It makes it easier to understand why politicians in Ottawa do not want to listen to injured workers concers now, when you see a former Cabinet Minister sitting as the President and CEO of the Canadian Chamber of Commerce. How can anyone consider themselve to be Honourable when they and their association finance these abusive WCB Boards in Canada?

Our rights have been stolen away by the businesses that finance this system known as the Workers Compensation Program, through legislation known as the Workers Compensation Act.

This legislation places injured workers at a major disadvantage and has resulted in far too many suicides because of the frustration these WCB Boards impose upon us. The WCB system is a denial program, forcing many injured workers into poverty. In the weeks ahead, I will explore the cause behind suicide within the injured worker familiy and in time, the families affected will speakout. The pain and hurt must stop and stop now and those politicians and their parties who turn their backs on us must be challenged.

The Workers Advisor Program is a joke and next week I will explain how that workrs. It was in 1999 and the Chief Workers Advisor Ann Clark informed me in a letter, that injured workers had no rights.

April 28th is a day of mourning for injured workers who died because of a workplace accident. Well , it is about time someone remembered those injured workers who were forced to take their own life...because of this abusive Workers Compensation system. Why haven't they been remembered ? or is the truth being buried with those poor souls?

Nova Scotia Workers'Compensation Board; Halifax, Nova Scotia

This building, built on the blood and bones of those injured workers who suffered at the hands of a very abusive system, exists today as a means of denying injured workers their just rights. If only these walls could talk … we would learn just how many injured workers committed suicide. This building is a fortress; a refuge for those who hide behind the protection of a"BAD FAITH LEGISLATION". (click on bad faith legislation and read all of Doctor Fillini's statement and you tell me if Doctor Bourke acted in "Good Faith" ?)

We have documentation which was turned over to me, in which the families are prepapred to pull the wraps off how the WCB really operates and caused deserving claimants so much shame and pain they were eventually stripped of all hope ... to the point that suicide was their only release. Heartfelt stories from wives, now nearly destitute, because their spouses chose suicide rather than trying to fight against an organisation that had stacked all the cards against them ... through legislation sanctioned by the Nova Scotia government and the policies of this Board. Something the WCB should be proud of ? I think not. I have been collecting and documenting this information since 1999.

No matter where you go in Canada, you don't have to look or listen very hard to find an horrific story about a provincial Workers Compensation Board that has used and abused injured workers at their most vulnerable.

Sad but true ...and, always "legal"... these legislated employer insurance providers, (W.C.B. Boards) are well known for their demonstrated incompetence, mismanagement, bungling, deceit, apathy, political meddling,( all expressed in the Dorsey Report) and their obvious bad faith actions ... excused and masked as innocent omissions while, in reality demonstrating the worst kind of cynicism and hypocrisy.

The Board of Directors are usually made up of political appointments, by one party or the other, three from the business community and, three or four union associates, nevertheless, all hand picked . The Nova Scotia Compensation Board and the Department of Labour went out of their way to hand pick and finance their own injured workers groups, which they only acknowledge as exisiting … the real reasons for their existence is a “secret”. I would also like to know just how involved the Nova Scotia Barristers Society is with the WCB? For sure, the Nova Scotia Department of Labour has fully cooperated and assisted in setting up one of the most vile, and untouchable, agencies of “government”.

Arms length, is the term the Office of the Minister of Labour likes to use …whenever anyone should dare to question the abuse administered by that vile agency. This is the sort of crap the Minister and his minions would have us all continue to believe, even though this flies in the face of the truth.

This board is to the “government” … and the business community who fund it, what Osama Bin Laden is to Al-Qaeda.

That opinion might sound a little extreme … unless you are in the position of one of the many hundreds of unlucky injured workers here in Nova Scotia that are dependent on the WCB to help them put their lives back together.

It is time we put a face on the Workers Compensation Board and point out, who the real stakeholders are. The truth is, you only become a stakeholder at the time of the workplace accident … while the business community, medical community, legal community and the unions, are always active within the board, plotting and conniving, who they will help … or more importantly from their perspective, who they will let hang. Because, injured workers in the province of Nova Scotia, certainly, is a big business. A lot of money changes hands as the result of workplace injury … the problem today is that very little of that money reaches those who truly need it most … injured workers.

For a start, let’s examine how it is that the injured worker has been subjected to such abusive treatment by a system that can act with impunity … because it is “legal”. Start with the business community which finances this vile agency of “government”.

Good corporate citizens all … or so they would have us all believe. Eagerly participating in an organization that was sold to workers and the public as a vehicle to “take care of” workers who succumb to injuries while on the job. Lofty and laudable reasons? Yes, they would be if there wasn’t a strong element of lying as to the real purpose behind the setting up of the WCB. Where do the business organizations like the Chamber of Commerce and The Federation of Independent Small Business stand? Do they approve of way the Workers Compensation Board does business? I would like to know if the Nova Scotia Barrister Society and the Atlantic Provinces Trial Lawyers Association agree with the abuse of injured clients by the Nova Scotia Workers Compensation Board?

In reality, this Board was set up to protect these fine corporate citizens from legal action and starve out injured workers and their families. After all, many of those claimants are simply charlatans ( in the eyes of the WCB ) who are goldbricking and really should be working. So what if their arms and legs may have been amputated, or, they’re in constant pain, half blind, crippled, can’t sit or stand for any length of time? There’s nothing wrong with them … they can work at something … there is no reason why they should sit home and collect a cheque from the WCB.

Because there is the WBC , and the “insurance” it provides, the employer, now, cannot be sued by the injured employee. Isn’t that great ? And the Board...can help those they are told to help, if the injured workers employer give the nod, the system is not flawed, it is corrupt.

In the months ahead we will be posting a story about a lady who was abused royally by this "government" legislated system. You’ll get to see all of these players in action: the Nova Scotia Workers Compensation Board; the Workers Advisor Program, the physiotherapy clinic the WCB sent her to, not to mention the way she was treated by her union. You will see the tactics used by various people in these offices to cheat her out of the monies she needed to live and survive. I will post documents signed and you will also get an opportunity to sit in on a meeting, taped of course, but nevertheless ...you will hear the crap that was pulled on her.

She was, misled and coerced into signing an agreement, which her union should never have let her sign. At the time, she was under so much pressure and intimidation, she was not capable of making a sound decision.

She was even told that I was not permitted to accompany her to any meeting related to her case … even though she had given me full access to her WCB file. This is just one more example, where her Charter of Rights where impinged upon or, should I say, abrogated.

This June, this injured worker will be terminated from receiving further benefits, she then will be free to talk openly about the mess the Office of the Minister of Labour and that agency created for her.

I will walk you all through this very abusive ordeal and, at the end of the day, you can be the judge. On trial will be a vile system … the very system that James Dorsey reviewed and said should be stripped down to nothing … and then rebuilt. Mr. Dorsey said that in 2002 and this lady was beat up since his review was done, so what has changed? Nothing ! And I am still waiting for a call from the Office of the Ministry of Labour.

Injured workers here in Nova Scotia pretty much resemble an abused wife in a bad relationship. Only our abusive spouse just happens to be the employer’s insurance provider, better known as The Nova Scotia Workers’ Compensation Board. ( Read this this part of the 2002 Focus Review Final Report on the WCB , by James Dorsey; pages 13, 14 ( LINK HERE ). And please go ( LINK HERE ) for the full Review.

Keep in mind, that the Nova Scotia Workers’ Compensation Board’s bargaining agent, is the (NSGEU) Nova Scotia Government and General Employees Union Local 55. This is the same union that negotiates the benefit packages for all public servants and guess what, this includes our elected MLAs. Is there any wonder why it is so hard for injured workers to be heard? What we have here is one cozy little unionized politicized family , putting the screws to injured workers here in Nova Scotia, not to mention the relationship those MLAs have with this union.

Dear Ms. Hess von Kruedener:

First, may I offer my heartfelt condolences to you in your present plight.
What happened to your husband troubles me … as it should all Canadians ... that Heir Harper and his “New” Conservative Party place far more importance on all things political while ignoring the human side with a cynicism that seems to exemplify this man and his “government”.

His reaction typifies the disdain and contempt this human anomaly seems to feel for all Canadians, lately … regardless of circumstance.

I’ll revert to the clichéd and say that “these things too shall come to pass” although, from experience, they may diminish, but, never go away.

I do agree with your reasoning of what took place and why. It is reprehensible to come to the realization that anyone is expendable if it means perpetuating the great myth.

The treatment you received from the governing "New" Conservative Party comes as no surprise to me... as I and thousands of others continue to be treated with disdain by this selfish and self-serving excuse for a party that has managed to high-jack our country while promoting its hidden agenda.

In 1968, Exercise Vacuum took place in Suffield Alberta. It was one of the largest Nuclear, Biological, Chemical Warfare exercises in Canadian history. Soldiers from The Queen's Own Rifles of Canada stationed in Victoria B.C. were used as guinea pigs during those experiments, along with other Canadian and American soldiers. thirty-nine years later, these men continue to present and suffer with health problems ( sometimes terminal) and are routinely dismissed as delusional or, simply opportunists.

In 1966 and 1967 Agent Orange defoliant was used to clear training areas at CFB Gagetown … a matter of record. But the government has only acknowledged the harm caused by Agent Orange when it was sprayed on Gagetown,proper. Those who were exposed in the training area during the spraying of Agent Orange , to this day, have NOT received any compensation from the criminals of the governing party of the day, namely the Liberal Party of Canada. As one of those exposed to that, I know, all too well, how these people will attempt to weasel out rather than face the truth. The fact that Harper's people have been fully apprised of what happened offers nothing positive,either.

All political parties are complicit when it comes to this very abusive process with which those of us, who, having served in the Canadian Military are treated … once we have been damaged, experience. Knowing what I know today... the way in which all political parties abuse our trust, I would never offer myself or suggest to any of my family that they serve. Unfortunately, for me, that’s hindsight. I served, I was exposed to Agent orange, and now, I’m embroiled in a fight with slime that likes to call itself “government”.

The stories about our First, Second World War, Korean War and Gulf War Veterans, who were made to go begging on their knees to some bureaucrat for their benefits, are not forgotten. Then ,too, there are the stories of veteran’s widows, who, to this day, continue to suffer at the hands of a bureaucratic system that is nothing but dispassionate toward the victims of wars…their wars.

Including, this heartless, self serving excuse we currently have for Prime Minister and his party associates who, apparently, have no compunction in allowing themselves to being reduced to lemmings who dance to the tune of Bush and Cheney.

I wish you everything good for the future. Try to move forward and don’t allow yourself to be quieted or stifled by those who are obviously your lessers.

Never give up … seeking justice for your husband, who truly stood for something … while this current party system, they like to call “democracy” and its politicians are prepared to stand for nothing … especially truth and morality. I have lost faith in what I once thought was a great and proud country… but seems to have been seduced/ touched by a cancer that, today, seems to be exemplified by the United States of America and those in its sphere of influence.

It is with a heavy heart, that I read your letter and as I do so , find myself very troubled with how your husband lost his life. I can only come to one conclusion and that is he was murdered along with his 3 other fellow Peacekeepers, by the State of Israel.

The treatment you received from the governing New Conservative Party is not a supprise to me, as I and thousands of other too have been treated with distain by this selfess excuse for a party that has high -jacked our system of governing for their own agenda.

To the Attention of Vice President AOAC

Hi Art:

We have to stop pointing at "government" as being the problem ... when in fact it is the political parties who are jerking the victims of Agent Orange around.

Political parties are controlled by men in suits, who own the chemicals and herbicides companies that were used at CFB Gagetown.

Companies like Monsanto, Uniroyal from Elmira Ontario, had to have political party support, to bring these chemical to market. These companies, with the influnce of the party system, together, abuse the power of "government", to posion those of us who were unlucky enough, to have served or lived at CFB Gagetown.

The sooner we taxpayers realize the damage that these political parties have done to this country and its citizens the better. It is time that the voters / taxpayers wake up to just how dirty these political parties are and how they all abuse the power and trust we place with in them. Please, if we are ever going to correct the wrongs done by these political parties, then we must STOP SUPPORTING THEM!

Mr. Vaughn Blaney is one good example of how and who the party system works for,!

Mr. Vaughn Blaney has done his job, for his political party friends, he was hired to sweep this Agent Orange problem under the rug and Mr. Vaughn Blaney did as he was instructed, plus he got very well paid for doing it too.

Dear Members of Parliament and the Canadian Senate.

We all know now that Canada played a major part in the production of Agent Orange chemicals and that these chemicals were used here in Canada. The Uniroyal plant in Elmira, Ontario was one of seven suppliers producing Agent Orange for the U. S. military's use in Vietnam, and in the province of New Brunswick, at Base Gagetown, as reported by governments own documentation.

Through their deceit, cover-up and negligence, the Canadian government has the blood of thousands of those who trained at Base Gagetown on their hands, not to mention the thousands citizens in Vietnam. To carry this even further, thanks to government documentation , we know that farmers in and around the area of the base were compensated because of drift.

Under the Geneva Convention, countries cannot be party to chemical warfare and must declare the use or supply of defoliants during conflicts. Therefore one can only take the position that the Canadian government knowingly breached the Geneva Convention , by permitting the use of Agent Orange back in 1966 and 1967. I use these dates, only because the Canadian government uses them for their own bases of paying out claims.

I have spoken with ex-military who were never informed about the use of Agent Orange while serving on the base in the years of 1966 and 1967, including myself. Once again, the Canadian government, breached the Geneva Convention by not informing myself or other that they were using AO on the training areas in New Brunswick.

It's bloody unacceptable what the Canadian government has done to us and the other countries whose troops trained at Base Gagetown.

A study released in August last year by scientists from the United States, Germany and Vietnam found that Agent Orange was still contaminating people through their food.

Dioxin, the defoliant's deadly component, can cause an increased risk of cancers, immunodeficiency’s, reproductive and developmental changes, nervous system problems and other health problems, according to medical experts.

Ken Dobbie the President of Agent Orange of Canada Association has even further proof that this chemical AO was used well before.

Ken Dobbie- “ Some time has gone by since the release of the information concerning the chemical defoliation of CFB Gagetown, I want to add a few facts.

2,4-D + 2,4,5-T (which the Americans called Agent Orange & Agent Purple) was negligently sprayed on the training area of CFB Gagetown from 1956 to 1964.

In 1964, there was a spraying accident involving a temperature inversion, which caused the Dioxin-laced spray to drift across the Saint John River to the market gardens of communities from Burton to as far down-river as Jemseg, primarily in the Sheffield to Maugerville area. However, the entire distance covered by the spray was 29 kilometres.”

The Canadian government are neglecting their responsibility to its own citizens, while professing they are interested in up holding the rights of Afghanistan citizens. The Minister of Veteran Affairs is playing games with the lives of those Canadian citizens and troops who have passed through Base Gagetown, it is time Thompson, got in step.

Ottawa is falling short of protecting its own, while they do so, many are left to go without proper medical treatment. Many have been denied rightfully compensation, remember it was the Canadian government who breached the Geneva Convention and it was they who failed to properly inform the soldiers that Agent Orange was being used.

Those private citizens employed at Base Gagetown, whose health was affected , are told to file with their provincial Workers Compensation Boards. Ottawa cannot pass the buck on this one, Ottawa must go to bat for those citizens, Ottawa was their employer and Ottawa is a major stakeholder in all provincial WCB Boards. This is a medical problem, created by Ottawa and they must address it with their provincial insurers.

According to the WCB Act in all provinces, Ottawa receives the protection of their Workers Compensation Legislation, therefore they can intervene, on behalf of those employed during 1966 and 1967. We must also take into consideration as well, that the province of New Brunswick, also breached the Geneva Convention, by giving permission for the use of Agent Orange. (Honourable is, as Honourable does )
